PREAMBLE

 

The Wisconsin Air National Guard (the “Guard”) is reconstructing certain of its facilities in Truax Field. Truax Field is located in lands that are part of the Dane County Regional Airport and owned by Dane County. A portion of an existing City of Madison Water Utility water main easement that serves the Guard's facilities is located such that it runs beneath existing buildings and concrete taxiways. As part of the reconstruction project, the Guard has requested that the water main be relocated. The Guard will pay the cost of relocating the water main. The Water Utility recommends that the water main be relocated as planned.

 

NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of the grant of a permanent limited easement from Dane County for a relocated water main and the release of the existing easement for that portion of the water main that is to be abandoned as requested by the Wisconsin Air National Guard for its reconstruction project.

 

BE IT FURTHER RESOLVED that the relocated water main location be supported by an easement map prepared by a registered land surveyor and that the legal description shall be an accurate representation of the as built location of the water main.

 

Legal Description of the Relocated Water Main Easement Area

 

 

A twenty-foot (20) wide easement located in the NE ¼ of the NW ¼ and the SE ¼ of the NW ¼ of Section 29, T8N, R10E, City of Madison, Dane County, Wisconsin, the Centerline of said easement being more fully described as follows:

 

Commencing at the Northwest corner of said Section 29; thence S 88º 31' 26" E, along the North line of said NW 1/4, 2126.02 feet; thence S 1º 28' 34" W, 891.52 feet to the beginning of said Centerline; thence S 46º 28' 46" W, 567.54 feet; thence S 0º 22' 36" W, 288.69 feet to the end of said Centerline.

 

The Easement Area includes all lands lying within ten (10) feet on both sides of said described Centerline as measured at right angles to said Centerline. The sidelines of said Easement Area are lengthened or shortened to terminate at the respective property lines or existing easement lines as appropriate.

 

 

Legal Description of the Portion of the Water Main Easement Area to be Released

 

 

A twenty-foot (20) wide easement located in the NE ¼ of the NW ¼ and the SE ¼ of the NW ¼ of Section 29, T8N, R10E, City of Madison, Dane County, Wisconsin, the Centerline of said easement being more fully described as follows:

 

Commencing at the Northwest corner of said Section 29; thence S 88º 31' 26" E, along the North line of said NW 1/4, 2126.02 feet; thence S 1º 28' 34" W, 891.52 feet to the beginning of said Centerline; thence S 1º 08' 39" W, 154.05 feet; thence S 40º 11' 11" E, 349.26 feet to the end of said Centerline.

 

The Easement Area includes all lands lying within ten (10) feet on both sides of said described Centerline as measured at right angles to said Centerline. The sidelines of said Easement Area are lengthened or shortened to terminate at the respective property lines or existing easement lines as appropriate.
