Authorizing the Common Council to accept ownership, from the Carpenter-Ridgeway Neighborhood Association, of an area of decorative landscaping located in 1300 Block of Carpenter Street right-of-way; and authorizing the maintenance of four decorative landscaping areas located in the 3100 to 3300 Blocks of East Washington Avenue and the one area within the 1300 Block of Carpenter Street, by the Carpenter-Ridgeway Neighborhood Association. 15th Ald. District.
Body
WHEREAS, the Carpenter-Ridgeway Neighborhood Association requested permission to install and maintain an area of decorative landscaping within the public right-of-way of the 1300 Block of Carpenter Street; and maintain four areas of decorative landscaping located in the medians of the 3100 to 3300 Blocks of East Washington Avenue, being installed as part of the reconstruction of East Washington Avenue; and
 
WHEREAS, the areas of decorative landscaping, located within the four medians of the 3100 to 3300 Blocks of East Washington Avenue, will be served by water service via a single water line and below-grade water valve of the water service which shall be installed and maintained by the City Engineer, as part of the reconstruction of East Washington Avenue; and
 
WHEREAS, the City Engineering and Traffic Engineering conditionally approved of the placement of the decorative landscaping and water line facilities; and
 
WHEREAS, the Privilege in Streets Committee has reviewed the request and approved it with conditions; and
 
WHEREAS, the Carpenter-Ridgeway Neighborhood Association will transfer ownership of the decorative landscaping located in Carpenter Street right-of-way to the City upon installation.
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison accepts ownership, from the Carpenter-Ridgeway Neighborhood Association, of an area of decorative landscaping located in Carpenter Street right-of-way; and authorizes the ongoing maintenance of four decorative landscaping areas located in the 3100 to 3300 Blocks of East Washington Avenue and one within the 1300 Block of Carpenter Street, by the Carpenter-Ridgeway Neighborhood Association, as shown on the attached exhibit; subject to the following conditions:
 
1.      The Carpenter-Ridgeway Neighborhood Association shall be responsible for all costs of installation and maintenance of the decorative landscaping in the 1300 Block of Carpenter Street, and the ongoing maintenance of the decorative landscaping located in the medians of the 3100 to 3300 Blocks of East Washington Avenue.
 
2.      The Carpenter-Ridgeway Neighborhood Association shall locate the decorative landscaping within Carpenter Street in specific areas, as approved by the City Engineering Division and City Transportation Department.
 
3.      The Carpenter-Ridgeway Neighborhood Association is responsible for locating all underground utility services in the Carpenter Street construction area, i.e., said Association shall contact Diggers Hotline prior to any excavation or construction activities.
 
4.      The installation of the decorative landscaping within the four medians of East Washington Avenue includes the water service via a single water line and below-grade water valve. The City shall maintain the water line and valve.
 
5.      The maintenance of the decorative landscaping located within the public right-of-way by the Carpenter-Ridgeway Neighborhood Association shall not interfere with traffic flow and any neighborhood maintenance personnel shall wear reflective safety vests during maintenance activities.
 
6.      The Carpenter-Ridgeway Neighborhood Association shall comply with all Madison General Ordinances regarding the construction and installation of the decorative landscaping within Carpenter Street, including any and all applicable City of Madison permits for excavation and installation, including a City Engineering Excavation Permit, if applicable.
 
7.      Decorative landscaping plants shall conform to the City Engineering planting guidelines regarding site clearance and height restrictions for the vision corners, and in any case, shall not exceed thirty (30) inches in height above the top of curb.  
 
8.      The Carpenter-Ridgeway Neighborhood Association shall obtain approval from the City Forester for any trees to be planted in the right-of-way.  Any trees installed shall be maintained by the City.
 
9.      The Carpenter-Ridgeway Neighborhood Association shall agree that the City shall not be held responsible for any damage to the decorative landscaping that may be caused by the City, its employees, contractors, or others.
 
10.      The City may remove the decorative landscaping located in Carpenter Street right-of-way if not properly maintained, by giving the Carpenter-Ridgeway Neighborhood Association sixty (60) days written notice prior to removal.  The Carpenter-Ridgeway Neighborhood Association is responsible for any reasonable costs associated with such removal.
 
11.      The City may remove the water service and decorative landscaping if the areas occupied by landscaping is required for transportation purposes, by giving the Carpenter-Ridgeway Neighborhood Association sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
