The proposed resolution conveys a 50-foot strip of land to Dane County that was excluded from the 1974 conveyance of property now known as Dane County Regional Airport. The land in question was excluded form the original conveyance of the land and has not been used and is not needed by the City. The land will be conveyed to the County for $1. No additional appropriation is needed to achieve the purpose of this resolution.

Title

Authorizing the City’s transfer and conveyance of a certain portion of a 50-foot-wide strip of remnant lands to Dane County. (District 18)

Body

WHEREAS, in 1974 the City of Madison (“City”) conveyed the property now known as Dane County Regional Airport (“Airport”) to Dane County (“County”) via Quit Claim Deed per Document No 1416749; and

WHEREAS, a 50-foot-wide strip of City-owned remnant land within the western Airport boundary adjacent to current and previous railroad lands (“Remnant Strip”) appears to have been omitted from the 1974 conveyance and remains titled to the City, as depicted on the attached Vicinity Map and Exhibit Map A. Since 1974, portions of the Remnant Strip have been developed by the County with Airport facilities and the City has not exercised any control of these lands; and

WHEREAS, Dane County is planning to construct an expansion of the Airport’s long-term surface parking lot north of Darwin Road and west of International Drive (“Project”). During the planning of the Project, the County discovered the legal existence of the Remnant Strip and brought it to the City’s attention; and

WHEREAS, a portion of the Remnant Strip lies within the limits of the Project and is now desired by the County for the planned expansion of parking to serve the Airport, with said portion legally described and depicted in attached Exhibit Map A; and

WHEREAS, in consultation with the Mayor, City Engineering staff have determined that the Remnant Strip has not been used and is not needed for City purposes and recommend that it be conveyed for One Dollar ($1.00) to the County to correct the apparent title omission and to support the Airport Project.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to execute and record a Quit Claim Deed conveying the Remnant Strip to the County, as legally described and depicted in the attached Exhibit Map A.

BE IT FURTHER RESOLVED that the City’s Common Council hereby authorizes the Mayor and City Clerk to take any further action required to accomplish the purpose of this resolution in a form approved by the City Attorney.
