The proposed resolution authorizes a non-competitive service contract with Destree Design Architects, Inc. for design services for the Tenney Park Beach Shelter at a total estimated cost of $80,000. Funding is available in the 2021 Adopted Capital Budget for Engineering Park Facility Improvements (Munis 10564). No additional appropriation is required.

Body
WHEREAS, The City of Madison has Targeted Business Enterprise (TBE) programs in place to ensure Small, Minority, & Women Business Enterprises are afforded the maximum feasible opportunity to compete in City contracting and procurement; and
WHEREAS, Individuals with purchasing authority can help level the playing field and advance contracting equity by utilizing these companies; and
WHEREAS, Destree Design Architects, Inc. is a City of Madison certified local business (offices at 222 West Washington), a City of Madison certified Small Business Enterprise (SBE), and a City of Madison certified Women Business Enterprise (WBE).
WHEREAS, Destree Design Architects, Inc. has proposed a sub-consultant services team that includes civil, structural, HVAC, plumbing, and electrical engineering; and,
WHEREAS, this contract is for design, bidding, and construction administration services for construction of a new Tenney Park Beach Shelter located in Tenney Park on Sherman Ave; and,
WHEREAS, the project will expedite the implementation of the Park Restroom Prototype Building to replace an existing undersized and outdated building and shelter and accommodate the clean beach treatment system equipment; and,
WHEREAS, Destree Design Architects, Inc has expertise on Parks prototype restroom buildings and public process and has completed a contract for architectural and engineering design services for the original Park Restroom Prototype Building designs in 2015, and has provided previous and continuing design services for prototype shelters located at Lake Edge, Esther Beach, Penn Park, Walter Street, and Warner Beach; and,
WHEREAS, under sec. 4.26(4)(b), of the Madison General Ordinances if the aggregate amount of the fee for services will be $50,000 or more and the contract was not subject to a competitive selection process, the contract shall meet one of the other requirements of sec. 4.26(4)(a) and be approved by the Common Council; and
Now Therefore be it Resolved that the Common Council hereby finds that in accordance with Madison General Ordinances, the contract does not require a competitive selection process because it meets the exception in MGO 4.26(4)(a)7, the consultant has performed similar work; and,
Be It Further Resolved that the Mayor and City Clerk are authorized to execute a services contract not to exceed $80,000 with Destree Design Architects for design services for the Tenney Park Beach Shelter.
