Staff costs associated with the participation in the environmental study called for in this agreement will be absorbed by existing staff. No other fiscal impact is expected.
Title
Authorizing the Mayor and City Clerk to execute an intergovernmental agreement with Dane County, the Town of Springfield, Town of Westport, Village of Waunakee and City of Middleton concerning the North Lake Mendota Parkway.
Body
WHEREAS the City of Madison, Dane County, Town of Springfield, Town of Westport, Village of Waunakee and City of Middleton have participated in the North Mendota Parkway Advisory Committee, which was charged with the formulation of an integrated strategy to improve transportation while minimizing secondary effects on lands within the North Mendota study area; and
 
WHEREAS the Committee approved a Final Report and recommendations on October 23, 2003; and
 
WHEREAS the final report contains recommendations that detail the process for the implementation of the Committee's goals and the recommendations in the report, including the execution of an intergovernmental agreement between and among the parties; and
 
WHEREAS the intergovernmental agreement has been reviewed and recommended for approval by the North Mendota Parkway Implementation Oversight Committee on July 19, 2006; and
 
WHEREAS the City of Madison is authorized to enter into this agreement under Section 66.0301, Wisconsin Statutes; and
 
WHEREAS the Department of Planning and Development has reviewed the North Mendota Parkway Study and draft agreement and supports the goals of the study and the proposal to undertake an environmental study as recommended in the intergovernmental agreement; and
 
WHEREAS the agreement calls for the preparation of an environmental study within the North Mendota Parkway Study area, the adoption of interim official maps and Comprehensive plans in conformity with the recommendations in the final report within six months of the execution of the agreement, the adoption of a formal North Mendota area plan within two years of the execution of the agreement, and contingent upon available funding, to cooperatively fund, design and construct the North Mendota Parkway; and
 
WHEREAS the Department of Planning and Development and City Attorney's Office have reviewed the proposed agreement and generally support its goals and recommendations with two important clarifications:
 
1.      Because official mapping of open space corridors will need to be based on more detailed planning and analysis than is included in the Final Report, the City of Madison's name should be removed from paragraphs 4, 6, and 8; and
2.      The agreement should contain an amendment indicating that the parties agree that the planning, funding and construction costs associated with the North Mendota Highway facility shall not be the responsibility of the City of Madison. (Note that the agreement already contains the same provision for Dane County.)
 
NOW THEREFORE BE IT RESOLVED that the Common Council authorizes the Mayor and City Clerk to execute the recommended intergovernmental agreement, North Mendota Parkway, as approved by the North Mendota Parkway Implementation Oversight Committee, contingent upon the following changes being made to the agreement:
 
1.      The City of Madison's name should be removed from Sections 4, 6 and 8, and
2.      Section 9 of the agreement entitled "Construction" shall be amended to add the City of Madison as a governmental unit not subject to any financial contributions.
