DRAFTER'S ANALYSIS:  Currently, violation of Madison Metro conduct regulations regarding use of radios, consumption of food or beverages, and littering are also ordinance violations punishable upon conviction by a forfeiture.  This amendment eliminates the status of these conduct regulations as ordinances except for the possession of an open container of alcohol beverage or consumption of alcohol beverages.

The Common Council of the City of Madison do hereby ordain as follows:
Section 11.045 entitled "Motor Buses - No Radios or Tape Players, or Consumption of Alcoholic Beverages" of the Madison General Ordinances is amended to read as follows:
"11.045      MOTOR BUSES - NO RADIOS OR TAPE PLAYERS, OR POSSESSION OF OPEN CONTAINERS OF ALCOHOL BEVERAGES, CONSUMPTION OF ALCOHOLIC BEVERAGES OR SMOKING.
(1)      It shall be unlawful for any person in a Madison Metro Bus within the jurisdictional limits of the City of Madison to:
(a)      Play radios, tape players or other similar devices, except if a device such as an earphone is used by the listener.
(b)      Consume any food and/or alcohol beverage, except for Metro Motorcoach Operators while taking a break from duty and except for infant feeding or possess an open container of alcohol beverages.  Alcohol beverages is defined in Sec. 38.02 of the Madison General Ordinances.
(c)      Dispose of any litter, garbage, or refuse.
(2)      A sign substantially bearing the words "No Radio or Tape Playing, Consumption of Alcohol Food and/or Beverages, or Littering Possession of an Open Container of Alcohol Beverages . . . City Ordinances" shall be displayed in a conspicuous place in each motor bus.
The provisions of this ordinance and Sec. 23.05 Madison General Ordinances, so far as it applies to motor buses, shall not apply to private charters."
                                                                                    
EDITOR'S NOTE:  The tobacco restrictions in 23.05 relating to motor buses are in Sec. 23.05(3)(b).  Section 23.05(3)(b) currently reads as follows:
"(3)      Prohibition of Smoking in Public Places.
