Fiscal Note

The proposed resolution authorizes the application for and acceptance of a Dane County Urban Water Quality Grant. The resolution also amends the 2022 Adopted Capital Budget for the Engineering-Major Streets Pleasant View Road project by increasing county sources of funding by $500,000. The 2022 Capital Budget will only be amended upon award of the grant.

Title

Amending the 2022 Capital Budget for Engineering-Major Streets to allow for the acceptance of a $500,000 grant from Dane County. (9th AD)

Body

WHEREAS, the City of Madison Engineering-Major Streets program is interested in obtaining a cost-share grant from the Dane County Land & Water Resources Department for the purpose of reconstructing Swallowtail Pond; and

WHEREAS, A resolution guaranteeing acceptance of the funds, should they be awarded to the City is necessary to apply for this grant; and

WHEREAS, the City of Madison Engineering staff attests to the validity and veracity of the statements and representations contained in Engineering’s grant application; and

WHEREAS, an Agreement with Dane County is required to accept the grant funds should they be awarded; and

WHEREAS, the City of Madison Engineering staff will complete the following tasks as required by Dane County to apply for and accept a grant: Sign and submit the grant application, if a grant is awarded enter into a Grant Agreement with Dane County, and submit final reports to Dane County as required by the Agreement, submit reimbursement request(s) to Dane County, sign and submit other documentation as necessary to complete the project per the Agreement, and

WHEREAS, the agreement requires that the City indemnify Dane County. City APM 1- requires Common Council Approval whenever the City indemnifies another party.

NOW, THEREFORE, BE IT RESOLVED, that the City of Madison Engineering is authorized to apply for and accept a Dane County grant and will meet the financial obligations necessary to fully and satisfactorily complete the project and hereby authorizes the Mayor and City Clerk to enter into an agreement with Dane County for the grant and authorizing the City Engineer to submit the required documentation to Dane County as required by the grant application.

BE IT FURTHER RESOLVED, that the City of Madison will comply with all local, state, and federal rules, regulations, and ordinances relating to this project and the cost-share agreement.

BE IT FURTHER RESOLVED, that the Common Council Approves indemnification of Dane County as set forth in the agreement in order to use grant funding for the reconstruction of Swallowtail Pond.

BE IT FINALLY RESOLVED, that the 2022 Adopted Capital Budget for Engineering-Major Streets shall be amended if the grant is awarded to increase the County sources budget authority in the Engineering-Major Streets program by the grant amount of $500,000.
