Fiscal Note
The City’s share of the cost of operating and maintaining the Badger Lane Lift Station is included in the 2023 Operating Budget submittal of the Sewer Utility (Munis project # 10268, Lift Station Rehabilitation and Replacement).
In 2023, the cost to the Madison Sewer Utility for this facility is anticipated to be $50,000 to design the replacement facility and $700,000 to replace the facility in 2024. These costs are anticipated to be shared based upon water usage in each municipality. (14th AD)

Authorizing the Mayor and City Clerk to enter into an Intergovernmental Agreement with the City of Fitchburg for the Ownership, Operation, and Maintenance of the Badger Lane Lift Station.(adjacent to AD 14)
Body
WHEREAS, under the terms of the Cooperative Plan entered into by the City of Madison (“Madison”), the City of Fitchburg (“Fitchburg”) and the Town of Madison (the “Town”), the Town will be absorbed by the Madison and Fitchburg, and the Town itself will cease to exist, on October 31, 2022 (the “Final Attachment”); and,
WHEREAS, the Badger Lane Lift Station (a necessary wastewater conveyance facility) is a Town owned and operated facility that serves sanitary sewer customers in Madison and the Town, pursuant to a 2010 intergovernmental agreement; and,
WHEREAS, after Final Attachment, and pursuant to the Town of Madison Assets and Liabilities Apportionment Agreement entered into by Madison and Fitchburg, the Badger Lane Lift Station will be owned by Madison, although it will continue to serve former Town parcels that will be located in Fitchburg; and,
WHEREAS, it is in the best interest of Madison and Fitchburg to enter into an agreement regarding the ownership, operation and maintenance of the Badger Lane Lift Station that reflects a simpler methodology for prorating cost for operation, maintenance, and replacement costs.
NOW THEREFORE BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to enter into an Intergovernmental Agreement with the City of Fitchburg for the Ownership, Operation and Maintenance of the Badger Lane Lift Station, on terms consistent with the agreement attached hereto, and in a format approved by the City Attorney.
