Fiscal Note
The proposed resolution authorizes Special Vending Approvals for 2024 special events that occur anywhere in the City where an ordinance restricts vending to certain types of food or articles, or only from assigned sites. This resolution allows for three exceptions to vending ordinances restrictions. There are 21 special events requesting special vending approvals for 2024.
• Suspension of rules - event sponsor requests suspension of the “homemade/handcrafted” vending rules in the Mall/Concourse area.
• Selection of vendors - authorizes event sponsors to select vendors for the event and requires they obtain a Special Event Vending License
• Invalidation of vending licenses - licensees with assigned sites inside the event perimeter cannot operate from the assigned site during the event, unless specifically exempted.
*For 2024* We have also included the State Street Pedestrian Experiment on the Special Event Resolution table this year. The hope is to suspend vending restrictions for any future events with vending that request that space. Including this initiative will also help coordinate with any new vendor locations in those blocks that may/may not need to move during a permitted Street Use event. The Mall/Concourse vending rules would only be suspended in these blocks with a Street Use permit or in conjunction with any licensing done by the Street Vending Coordinator for the City of Madison. If we get events with vending in this location, they would be charged the vending permit fees based on the number of vendors and it would increase the revenue estimate below.
Under MGO 9.13(2)(c), Special Event Vending Licenses are issued for event vendors in the name of the event sponsor. Approval of this resolution will result in $8,800 in City revenue from Special Event Vending Licenses and is included in the Parks Division's 2024 Operating Budget. Five event sponsors requesting special vending approvals do not sell food or goods and, therefore, are not required to purchase a license. Other actions authorized in this resolution do not result in a fiscal impact.
In general, city licensed vendors pay an annual fee for their licenses, which come with the caveat that their license may be invalidated up to 10 times per year per location. The invalidation of licenses due to the special events does not impact revenue.
