Fiscal Note
Under this program, MG&E would buy back the photovoltaic (PV)-generated power at the rate of 25 ct/kWh instead of the regular rate of 10 ct/kWh. This would increase annual revenues at 1602 Emil Street by $788 annually, and also provide revenues of $3,000 annually for future PV systems at Alicia Ashman Library , Greentree and Demetral Landfills combined. The City Risk Manager has indicated that the City's existing insurance policy applies, subject to its terms and conditions, to the risk imposed by the indemnification provisions. No additional appropriation is required.

Authorize the Mayor and City Clerk to sign the Clean Power Partner Agreement as required to apply for the Madison Gas and Electric Company's Clean Power Partners program.
Body
Whereas, the City has applied for participation in Madison Gas and Electric Company's Clean Power Partners program, under which the City would install photovoltaic (solar) power equipment and various city sites and MG & E would buy back the PV-generated power at the rate of 25 ct/kWh instead of the regular rate of 10 ct/kWh; and
Whereas, participation in this experimental program is limited and awarded on a first-come, first served basis; and
Whereas, in order to apply to the program, MGE is requiring applicants to sign an agreement called the Clean Power Partner Agreement, which commits the applicant to comply with certain standards, complete the installation of the PV equipment and connect to MGE's power grid within 12 months of signature; and
Whereas, the Clean Power Partner Agreement also requires the applicant to commit to signing a standard Distributed Generation Interconnection Agreement, which, according to PSC rules, requires mutual indemnification between the applicant and MGE; and
Whereas, APM 1-1 requires Common Council approval before the City indemnifies another party in a contract; and
Whereas, the Risk Manager and City Attorney recommend seeking a waiver of this provision from the PSC for future photovoltaic interconnection generation agreements as described in Resolution ID #08778 and MGE has agreed to contract provisions for this Clean Power Partner Agreement that recognizes that possibility; and
Whereas, further council approval will be sought for future stages of this program beyond the application process, including signing the Distributed Generation Interconnection Agreement(s) for each site and a substitute for ID #08778 will be prepared accordingly;
NOW, THEREFORE, BE IT RESOLVED that the Common Council hereby approves the City's participation in MG & E's "Clean Power Partner" program; and
BE IT FURTHER RESOLVED that the Common Council authorizes the Mayor and City Clerk to sign the Clean Power Partner Agreement as required to apply to this program.
