Repealing Section 12.26 of the Madison General Ordinances which created restrictions on opening vehicle doors in traffic.

DRAFTER'S ANALYSIS: This ordinance is being repealed because the Wisconsin Legislature has recently adopted Wis. Stat. ยง 346.94(20) Opening Motor Vehicle Door on Highway and therefore the statute would supersede the City ordinance. The City will adopt this statute by MGO 12.011 and issue violations under the statute.

The Common Council of the City of Madison do hereby ordain as follows:
1. Section 12.26 entitled "Opening Vehicle Doors" of the Madison General Ordinances is hereby repealed.
2. Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by amending therein following:

EDITOR'S NOTE: Sec. 12.26 currently reads as follows:
"12.26 OPENING VEHICLE DOORS. Any person who does any of the following within the limits of the City of Madison shall be subject to a forfeiture of not less than twenty dollars ($20) nor more than two-hundred dollars ($200):
(1) No person shall open the door of a vehicle on the side nearest to traffic unless and until it is reasonably safe to do so and does not interfere with the movement of other traffic.
(2) No person shall leave a door of a vehicle open on the side nearest to traffic for a period of time longer than is reasonably necessary to load or unload passengers or property."
