Fiscal Note
It is anticipated that the City Clerk and four Judicial Support Clerks will require bonding. The Risk Manager estimates total costs for the five bonds at approximately $1,500. Costs will be paid for by the Insurance Fund. No appropriation is necessary.

Amending Section 3.31 and 3.16 of the Madison General Ordinances to require that the Clerk, Deputy Clerk and Municipal Court Clerks file an official bond.

DRAFTER'S ANALYSIS: This proposal requires the City Clerk, City Deputy Clerk, and Municipal Court Clerks to file an official bond in the amount of $2,000. Although the statutes do not expressly require a bond for city clerks, such a bond is implied by Wis. Stat. § 62.09(11)(i).

The Common Council of the City of Madison do hereby ordain as follows:
1. The introductory paragraph of Section 3.31 entitled "Bonds to be Filed by City Officers" of the Madison General Ordinances is amended to read as follows:
"3.31 BONDS TO BE FILED BY CITY OFFICERS. The amount of the bonds required by Wis. Stat. §§ 62.09(4)(b) and 62.09(11)(i), to be paid by the City and to be filed by certain City officers shall be as follows:"
2. Subsection (3) entitled "Clerk and Deputy Clerk" of Section 3.31 entitled "Bonds to be Filed by City Officers" of the Madison General Ordinances is created to read as follows:
"(3) Clerk and Deputy Clerk. Two thousand dollars ($2,000)."
3. Subsection (4) entitled "Municipal Court Clerks" of Section 3.31 entitled "Bonds to be Filed by City Officers" of the Madison General Ordinances is created to read as follows:
"(4) Municipal Court Clerks. Two thousand dollars ($2,000)."
4. Subsection (7) entitled "Employees" of Section 3.16 entitled "Municipal Court for the City of Madison" of the Madison General Ordinances is amended to read as follows:
"(7) Employees. The Court shall be staffed by such personnel as are authorized by the Common Council. Such employees shall be selected through the Civil Service process as are other City employees holding similar positions and shall be appointed by and operate under the jurisdiction of the Municipal Judge or, in the case of a vacancy in the office Municipal Judge, the Mayor. One of said persons shall be designated by the Municipal Judge and act as the Clerk of Municipal Court. The Court staff shall, before entering upon the duties of their offices, take the oath provided by Sec. 19.01, Wis. Stats., which oath shall be filed with the City Clerk. The Court staff shall also give a bond in the amount of two thousand dollars ($2,000) as provided in Section 3.31(4), the cost of which shall be paid by the City, which bond shall be filed with the City Clerk."
