Accepting a Public Storm Water, Sanitary Sewer and Water Main Easement from The Lenhart Company, Inc. and Owl Creek Drive L.L.C., across properties located at 4017 and 4035 Owl Creek Drive. 16th Ald. District.

Body

WHEREAS, in accordance with the Contract for Subdivision Improvements - Madison Commerce Park CSM - Contract No. 1877, the owners are required to dedicate, at no cost to the City of Madison, a Public Storm Water, Sanitary Sewer and Water Main Easement across the properties located at 4017 and 4035 Owl Creek Drive; and

 

WHEREAS, the owners, The Lenhart Company, Inc. and Owl Creek Drive, L.L.C., have executed and delivered such Public Storm Water, Sanitary Sewer and Water Main Easement to the City; and

 

WHEREAS, City of Madison Engineering Division and Water Utility staff have reviewed and recommend the acceptance of the easement.

 

NOW, THEREFORE, BE IT RESOLVED that the City of Madison is hereby authorized to accept from The Lenhart Company, Inc. and Owl Creek Drive, L.L.C, at no cost to the City of Madison, a Public Storm Water, Sanitary Sewer and Water Main Easement across the following described lands:

 

A part of Lot 4, Madison Commerce Park, recorded in Volume 57-183B of Plats on pages 765 and 766 as Document No. 3367639, Dane County Registry, and a part of Lot 1, Certified Survey Map No. 10462, recorded in Volume 62 of Certified Survey Maps, pages 1-4, Dane County Registry, all located in the NE ¼ of the SE ¼ of Section 27, T7N, R10E, City of Madison, Dane County, Wisconsin, to-wit:

 

Commencing at the Northeast corner of said Lot 4; thence S01°37'33"E, 300.00 feet; thence S88°22'26"W, 330.00 feet; thence N48°32'46"W, 45.19 feet to the point of beginning; thence S41°27'14"W, 35.00 feet; thence N48°32'46"W, 33.78 feet to a point on a curve; thence northeasterly on a curve to the left which has a radius of 385.00 feet and a chord which bears N39°53'40"E, 45.02 feet; thence S48°32'46"E, 35.00 feet; thence S41°27'14"W, 10.00 feet to the point of beginning.   Containing 1,528 square feet.
