Funding to support the operations of the newly constituted Community Development Division and the reconstituted Economic Development Division is included in the 2008 Adopted City operating budget.  No additional appropriation is required.

DRAFTER'S ANALYSIS:  This ordinance divides the Economic and Community Development Division of the Department of Planning and Community and Economic Development into an Economic Development Division and a Community Development Division.  It moves responsibility for the Community Development Block Grant Office, the Senior Center, and the Office of Community Services to the Community Development Division.  This ordinance implements part of Amendment No. 31 to the Operating Budget.  Additional ordinance changes for personnel issues arising from the Budget amendment will be done by separate ordinance.
 
In addition, during the ordinance changes to Chapter 3 and the Department reorganization, reference to the Senior Center Board was inadvertently dropped from the ordinances.  This ordinance restores the Senior Center Board as Sec. 33.14, MGO.

The Common Council of the City of Madison do hereby ordain as follows:
 
1.      Subsection (2) entitled "Composition of Department" of Section 3.12 entitled "Department of Planning and Community and Economic Development" of the Madison General Ordinances is amended to read as follows:
 
"(2)      Composition of Department. The Department of Planning and Community and Economic Development shall consist of a Director of Planning and Community and Economic Development, the Planning Division, the Neighborhood Preservation and Inspection Division, the Economic and Community Development Division, the Community Development Division, and the Housing Operations Division."
 
2.      Subsection (6) entitled "Economic and Community Development Division" of Section 3.12 entitled "Department of Planning and Community and Economic Development" of the Madison General Ordinances is amended to read as follows:
 
"(6)      Economic and Community Development Division.  This Division includes the Office of Real Estate Section Services, the Community Development Section Office of Economic Revitalization, the Community Development Block Grant Office, the Senior Center, the Office of Community Services, and the Office of Business Resources. Under the direction of the Economic and Community Development Division Director, this division is responsible for:
(a)      administering the City's economic development plan and promoting the economic development of the City, including tax incremental financing,
(b)      managing and coordinating the tools to revitalize neighborhoods and commercial areas through the Community Development Section Office of Economic Revitalization, including coordinating the provision of staff services to the Community Development Authority,
(c)      performing real estate services for the City, including property acquisition and disposition, management, investigation and relocation through the Office of Real Estate Section Services, and
(d)      planning, developing and implementing a variety of programs, services and activities of interest to older people, through the Senior Center,
(e)      planning, developing, implementing and evaluating community services and human services including services purchased by the City from non-profit agencies, through the Office of Community Services,
(f)      promoting healthy neighborhoods and a viable urban community through support of effective community oriented programs including services purchased by the City from private non-profit agencies through the Community Development Block Grant Office, and
(g)(d)      providing advice and connections to a variety of information and assistance to retain, grow and attract businesses, and to promote healthy employment and commercial areas, through the Office of Business Resources."
 
3.      New Subsection (7) entitled "Community Development Division" of Section 3.12 entitled "Department of Planning and Community and Economic Development" of the Madison General Ordinances is created to read as follows:
 
"(7)      Community Development Division.  This Division includes the Community Development Block Grant office, the Senior Center, and the Office of Community Services.  Under the direction of the Community Development Division Director, this division is responsible for:
(a)      planning, developing and implementing a variety of programs, services and activities of interest to older people, through the Senior Center,
(b)      planning, developing, implementing and evaluating community services and human services including services purchased by the City from non-profit agencies, through the Office of Community Services, and
(c)      promoting healthy neighborhoods and a viable urban community through support of effective community oriented programs including services purchased by the City from private non-profit agencies through the Community Development Block Grant Office."
 
4.      Current Subsections (7) through (9) of Section 3.12 entitled "Department of Planning and Community and Economic Development" of the Madison General Ordinances are renumbered to Subsections (8) through (10), respectively.
 
5.      Section 33.14 entitled "Reserved for Future Use" of the Madison General Ordinances is amended to read as follows:
 
"33.14      RESERVED FOR FUTURE USE SENIOR CENTER BOARD.  
(1)      The Senior Center Board shall serve as an advisory body to the Department of Planning and Community and Economic Development and to the Mayor and Common Council.
(2)      The Senior Center Board shall be composed of twelve members, eleven of whom shall be appointed by the Mayor and confirmed by the Common Council. Terms of the appointments shall be for three years with the exception that the term of any Alderperson shall be two years but only so long as such Alderperson holds said office and with the additional exception that the term of the member of the Senior Citizens Advisory Committee shall terminate upon that person's termination from the Senior Citizens Advisory Committee. Initial appointments shall be four members for three years, four members for two years, and three members for one year. Members shall be citizens of the City of Madison and shall be knowledgeable and experienced in the provision of senior services. One member shall be an Alderperson and one shall be a member of the Senior Citizens Advisory Committee. The Senior Services Coordinator shall also serve as an ex officio, non-voting member of the Board.
(3)      The Senior Center Board shall be responsible for raising funds; developing programs, policies and services for the Center; encouraging the provision of senior services at the Center; maintaining liaison with the Senior Citizens Advisory Committee; and other related work which is consistent with or enhances these functions."
 
6.      The City Attorney is directed to make corresponding changes to other City ordinances to reflect these new titles and officials.
