Fiscal Note

The proposed ordinance amendment would allow Parks Division staff to administratively approve street use permits for routine requests for meter bags when the request is not for a full street closure. There is no anticipated fiscal impact.

Amending Section 10.056(5)(b)5. of the Madison General Ordinances to allow administrative approval of a street use permit application to close on-street parking meter space(s) as permitted by sec. 12.1425, MGO.

Body

DRAFTER’S ANALYSIS:    The Street Use Ordinance currently requires almost all applications for street use permits to come before the Street Use Staff Commission for approval at a public meeting. This amendment would allow Parks Division staff to administratively approve street use permits for routine requests for meter bags under MGO 12.1425(3)(a)2., when the request is not for a full street closure. The Traffic Engineering Division issues meter bags and this ordinance does not change that process or the reasons for which a person can obtain a parking meter bag.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     1.                     Paragraph 5 entitled “Administrative Review for Certain Applications” of Subdivision (b) entitled “Permit Review” of Subsection (5) entitled “Application Process and Permit Requirements” of Section 10.056 entitled “Street Use Permit” of the Madison General Ordinances is amended as follows:

 

“5.                     Administrative Review for Certain Applications . The following applications may be reviewed and approved administratively by a designee of the Parks Superintendent. Such applications shall be approved if the Parks designee finds that the Standards of Issuance and all other applicable criteria under this ordinance have been met, including any insurance that may be required under Sec. 10.056(8). The decision on an application made under this section shall be made within the time limits in Sec. 10.056(5)(f) unless waived by the applicant.

a.                     Applications for the use of not more than two (2) blocks of a residential, non-Mall/Concourse local street meeting all of the criteria of Sec. 10.056(4)(c), including the petition requirement, may be reviewed and approved administratively by a designee of the Parks Superintendent. Such applications shall be approved if the Parks designee finds that the Standards of Issuance and all other applicable criteria under this ordinance have been met, including the insurance provisions under 10.056(8). A decision on a permit under this section shall be made within the time limits in Sec. 10.056(5)(f).

b.                     Applications for a temporary “No Parking Zone” when the request is for meters or areas on streets that are not completely closed to traffic, as permitted by Sec. 12.1425(3)(a)2., MGO.
