WHEREAS, the City of Madison on June 12, 1973 adopted Resolution No. 24,966, File Number 5035-6, adding Official Map Sections 22, 27 and 34, Town 7 North, Range 8 East; and
 
WHEREAS, the City of Madison Official Maps, added by said resolution, contained various proposed streets and parkways, including proposed Pleasant View Road from existing Valley View Road north to Mineral Point Road; and
 
WHEREAS, the current adopted City of Madison Pioneer Neighborhood Development Plan includes relocated Pleasant View Road; and
 
WHEREAS, the City of Madison has reviewed and conditionally approved the preliminary plat of "University Research Park-Pioneer" submitted by the University of Wisconsin Board of Regents for lands included in the said Pioneer Neighborhood Development Plan; and
 
WHEREAS, the City of Madison on September 5, 2006 adopted Resolution No. RES-06-00716, File ID No. 04115 which Determined a Public Purpose and Necessity and approved a Relocation Order for the acquisition of lands from the Theis property for Pleasant View Road right-of-way purposes; and
 
WHEREAS, the City of Madison filed the previously adopted Resolution No. RES-06-00716, File ID No. 04115 with the Dane County Clerk as Right-of-Way Plat No. 654; and
 
WHEREAS, since adopting said RES-06-00716 on September 5, 2006, the City of Madison Common Council, in reviewing the proposed geometrics for Pleasant View Road and in recognition of the comments from representatives of the Theis property and the adopted Pioneer Neighborhood Development Plan,has recommended that alternative  design alignments for Pleasant View Road be evaluated to move the proposed road closer to the eastern Theis property line; and
 
WHEREAS, recently the City of Madison Engineering Division has coordinated Pleasant View Road design changes with Ayres and Associates which physically moves the proposed alignment of Pleasant View Road to the east; and
 
WHEREAS, as a result of these recommendations  by the Common Council , the proposed University of Wisconsin Board of Regents Subdivision Plat "University Research Park-Pioneer" requires revisions to the proposed dedications for Pleasant View Road public right-of-way and these changes will be communicated and coordinated by the City of Madison with the University of Wisconsin Board of Regents by means of their final plat approval process; and
WHEREAS, the City of Madison Engineering Division has created City Project No. 53W0143 - Pleasant View Road - UW Research Park West; and
 
WHEREAS, the City of Madison will administer the acquisition of required land interests as identified on the attached Relocation Order and plat of right of way and all associated costs to the City of Madison will be available in the City of Madison Engineering Division City Project No. 53W0143 - Pleasant View Road - UW Research Park West; and
 
WHEREAS, all required funding for the land interest acquisition is available in Account No. CS53-58110-810543-00-53W0143; and
 
WHEREAS, the City of Madison Office of Real Estate Services has created Project No. 8531 - as a master file to administer all necessary land interest acquisitions; and
 
WHEREAS, preliminary plans indicate necessary land interest acquisitions from the Theis property, assuming dedication for the remaining interests by the preliminary University Research Park-Pioneer plat; and
 
NOW COMES THE CITY OF MADISON, Dane County, Wisconsin, by its City Council and for its Relocation Order hereby resolves as follows:
 
1.      That by adoption of this Resolution as a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes, the previously adopted RES-06-00716 adopted on September 5, 2006 and filed with the Dane County Clerk as Right-of-Way Plat No. 654 is hereby rescinded, inclusive of all associated maps and legal descriptions and replaced by this adopted Relocation Order;
 
2.      That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessary in accordance with Section 32.07(2), Wisconsin Statutes, and that the acquisition shall allow for the construction of public improvements related to Pleasant View Road;
 
3.      That the City of Madison Office of Real Estate Services of the Economic Development Division and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Relocation Order, and the Office of Real Estate Services is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition;
 
4.      That the City of Madison Office of Real Estate Services of the Economic Development Division is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary;
 
5.      That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition;
 
6.      That the City Clerk shall file this Relocation Order with the Dane County Clerk in accordance with Section 32 of the Wisconsin Statutes;
