To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE certain Mall/Concourse vending licenses on Sunday, May 29 during MADISON MARATHON and authorizing Madison Festivals Inc., as sponsor of the special event, to select vendors, vending sites and performers for the duration of the event on the 10 blocks of E. & W. Main St., 10 blocks of N. & S. Carroll and Pinckney and the 100 & 200 blocks of Martin Luther King, Jr. Blvd.
Body
WHEREAS, Section 9.13 (6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and
 
WHEREAS, Section 9.13 (6)(k)1 allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and
 
WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and
 
WHEREAS, the MADISON MARATHON is such a special event; and
 
WHEREAS, Madison Festivals Inc. , as sponsor of the special event, agrees to obtain a Street Use Permit for the setup and conduct of this event from 7:00a.m. May 28 to 5:00p.m. May 29, 2011, and agrees to comply with the conditions of the permit, including but not limited to any conditions placed on the permit by the Street Use Staff Commission; and
 
WHEREAS, Madison Festivals Inc. , wishes to insure the integrity, comprehensiveness and success of MADISON MARATHON  by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Common Council; and
 
WHEREAS, the sponsors agree to comply with all recommendations of the Street Use Staff Commission and the Vending Coordinator concerning the location of vending sites and use of electricity; and
 
WHEREAS, street vending or Mall/Concourse vending licenses will be invalidated at this location not more than ten times in the year 2010, including this event:
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council hereby SUSPENDS the vending restrictions relating to handcrafted goods, personally prepared food set forth in 9.13(6)(b) of the Madison General Ordinances for the streets specifically described above; for Sunday, May 29 2011 from 6:00a.m to 5:00p.m.
 
BE IT FURTHER RESOLVED that the Common Council establishes an alternate rule for vending to allow the event sponsor the right to select additional vendors, salespersons and vending sites within the above-described streets on Sunday, May 29 2011 from 6:00a.m to 5:00p.m. subject to the conditions of the Street Use Permit for placement of vending sites and equipment
 
BE IT FINALLY RESOLVED that the Common Council hereby INVALIDATES all Mall/Concourse vending licenses, with the exception of sidewalk cafe licenses, within above-described streets and sidewalks Sunday, May 29 2011 from 6:00a.m to 5:00p.m.
