Fiscal Note

No City appropriation is required with the approval of this Certified Survey Map. City costs associated with urban development in this area will be included in future operating and capital budgets subject to Common Council approval.

 

Title

Re-approving a Certified Survey Map of property owned by Hidden Creek Holdings, LLC located at 4205 Portage Road (District 17).

 

Body

WHEREAS a Certified Survey Map of property owned by Hidden Creek Holdings, LLC located at 4205 Portage Road, City of Madison, Dane County, Wisconsin has been duly filed for approval by the Plan Commission, its Secretary or their designee, as provided for in Section 16.23(4)(f) of Madison General Ordinances; and

 

WHEREAS the Common Council previously approved this Certified Survey Map by Resolution 23-00127 (ID 73801) on February 7, 2023 following a recommendation by the Plan Commission on January 23, 2023; and

 

WHEREAS Chapter 236, Wisconsin Statutes requires that the Madison Common Council approve any dedications proposed or required as part of the proposed division of the lands contained on said Certified Survey Map; and

 

WHEREAS Wis. Stat. 236.34(2)(b) requires that a Certified Survey Map be offered for recording within twelve (12) months of the approval of same; and

 

WHEREAS the applicant and property owner has worked with City staff to refine the design of the land division and associated residential building complex, said refinements and redesign requiring that certain conditions of the 2023 land division approval be revised or removed;

 

NOW THEREFORE BE IT RESOLVED that said Certified Survey Map, bond and subdivision contract, subsequent affidavits of correction, parkland acquisition documents, easement or right-of-way release or procurement documents or any other related document or documents as deemed necessary by the Secretary of the Plan Commission in accordance with the approval of said Certified Survey Map are hereby approved by the Madison Common Council subject to the conditions of approval contained in the amended approval letter dated February 6, 2024.

 

BE IT FURTHER RESOLVED that the Mayor and City Clerk of the City of Madison are hereby authorized to sign the above mentioned documents related to this Certified Survey Map.

 

BE IT FURTHER RESOLVED that all dedications included in this Certified Survey Map or required as a condition of approval of this Certified Survey Map be and are hereby accepted by the City of Madison.

 

BE IT FURTHER RESOLVED that the Common Council authorizes City staff to request approval from the Capital Area Regional Planning Commission of any minor revisions to adopted environmental corridor boundaries within the Central Urban Service Area relating to this land division, and that the Council recognizes and adopts said revised boundaries.

 

BE IT FURTHER RESOLVED that the Planning Division is authorized to reflect the recorded Certified Survey Map in the Comprehensive Plan and any applicable neighborhood plans.
