PREAMBLE
The Wisconsin Department of Transportation (WDOT) is proposing to reconstruct IH 94 from the Badger Interchange to CTH N. The project includes the reconstruction of the structure over Sprecher Road and the construction of a new structure over the proposed extension of Milwaukee Street. The structure at Sprecher Road is in poor condition and nearing the end of its service life. WDOT has determined that the bridge should be replaced. The proposed project is planned for construction in the year 2010. In conjunction with the proposed project, the Sprecher Road structure will be built to accommodate the cross section expansion of Sprecher Road and the Milwaukee Street structure will be built to accommodate the cross section of the proposed extension of Milwaukee Street.
The City of Madison and the WDOT propose to enter into an agreement for construction and cost sharing of the proposed project. The basis for cost sharing participation is as follows:
1) Design Engineering: All design-engineering costs necessitated by the street or road construction is 100% eligible for State Funding.
2) Real Estate Acquisition: The City is responsible for 100% of the cost of new right-of-way needed for the proposed Milwaukee Street extension grade separation structures that would not otherwise be needed for the IH 94 expansion project. The State will perform all real estate acquisition activities as part of the IH 94 lane expansion work and retain ownership of this additional right-of-way when the project is complete.
4) Sprecher Road Eastbound (B-13-498) and Westbound (B-13-499) Structures: The State is responsible for 100% of the cost of the new Sprecher Road structures that will accommodate the cross section expansion of Sprecher Road under IH 94.
5) Milwaukee Street Extension Eastbound (B-13-549) and Westbound (B-13-550) Structures: The State and the Municipality are each responsible for 50% of the cost of the proposed Milwaukee Street extension grade separation structures and excavation.
6) Sprecher Road Construction: As requested by the City, only the southbound lanes of the wider Sprecher Road cross section under IH 94 will be reconstructed. The State is responsible for replacing the existing roadway under IH 94 if damaged during construction; therefore the State will participate in 100% of the cost of reconstructing the southbound lanes of Sprecher Road only. As determined by the State, the limits of the reconstruction on Sprecher Road will be the touchdown points that provide the required 15'-3" vertical clearance under the new bridges meeting the appropriate vertical and/or horizontal alignment standards.
7) Local Utilities: The City shall pay for 100% of the cost of installing or adjusting new water and sanitary sewer mains. The City assumes full responsibility for the design, installation, testing and operation of the sanitary sewer and water system.
8) New Sidewalk: The City is responsible for 100% of the cost of new sidewalk on Sprecher Road and the proposed Milwaukee Street extension.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute agreements with the State of Wisconsin Department of Transportation for cost sharing for the reconstruction of the IH 94 structure over Sprecher Road and the new construction of the IH 94 structure over the proposed extension of Milwaukee Street.

State/Federal Cost: $48,323,600
City Cost: $ 1,585,000
Funds will be required in future Capital Budgets. The City's share of approximately $1,585,000 is included in the 2009-2013 Capital Improvement Program approved by the Board of Estimates. Real estate acquisition will take place in 2009 and the City's share is $267,900. Construction is scheduled for 2010 and the City's share is $1,317,100.
