Preamble
On August 12, 2003 the City of Madison entered into a Memorandum Of Understanding (MOU) with the WDOT that provided for cost sharing on 4 bridges over the interstate including the Marsh Road Bridge over the Beltline Highway. The agreement also allowed for the advancement of the Marsh Road Bridge over the Beltline Highway by financing an amount in excess of the normal City share in exchange for a credit later on future bridge projects identified in the MOU. Those projects include the Cottage Grove Road, Buckeye Road and Milwaukee Street Bridges over Interstate 90. The WDOT did not have sufficient funds available to finance the Marsh Road Overpass project at that time. On June 30, 2003, in accordance with the MOU, the City entered into a Project Agreement with the WDOT for construction of the Marsh Road Bridge over the Beltline Highway and funded the local share with funds from TID 24.
On May 18 2006 the City of Madison entered into a revised agreement for the West Beltline Frontage Road / Todd Drive Project that used the entire credit identified in both the MOU and the Project Agreement for the Marsh Road Overpass on the West Beltline Frontage Road / Todd Drive Project. On May 18, 2006, the City of Madison entered into a revised agreement for the Cottage Grove Road / CTH BB Overpass of Interstate 90 that called for the use of local funds in place of the credit for the City of Madison share of the Project.
This resolution authorizes the execution of an agreement that updates the existing Marsh Road Overpass Agreement to reflect what the City has agreed to in both the West Beltline Frontage Road / Todd Drive Agreement and the Cottage Grove Road / CTH BB Overpass Agreement. This resolution also terminates the MOU for Bridge Improvements on the East Side of Madison. The MOU is out of date in respect to the use of the credit.
Now Therefore be it resolved that the Mayor and City Clerk are hereby authorized to execute a revised agreement with the Wisconsin Department of Transportation for the Marsh Road Overpass of the South Beltline Highway (USH 12/18), and
Be it further resolved that the Mayor and City Clerk are hereby authorized to terminate the existing Memorandum of Understanding for Bridge Improvements on the East Side of Madison.
