Fiscal Note
Under the terms of the City of Madison/Town of Middleton Cooperative Plan, annexation of non-commercial property such as is proposed in this Ordinance is exempt from revenue sharing requirements.  Therefore, no appropriation is required in conjunction with this annexation.

DRAFTER'S ANALYSIS:  This ordinance attaches land in the Town of Middleton pursuant to the procedure in the City of Madison/Town of Middleton Cooperative Plan.

An ordinance to create Subsection (564) of Section 15.01 of the General Ordinances of the City of Madison entitled "City Boundaries" and being part of the chapter entitled "Aldermanic Districts and Wards".
 
WHEREAS, a petition for attachment with scale map attached was filed with the City Clerk of Madison on May 10, 2007 and has been presented to the Madison Common Council requesting attachment of the below-described territory to the City of Madison from the Town of Middleton; said petition having been signed by the owners of all of the land in the territory and notice of the proposed attachment having been given to the Town of Middleton; and
 
WHEREAS, investigation by the City of Madison discloses that as of this date the above representations are true, the Common Council now accepts the petition as sufficient and determines that the said attachment proceeding meets the requirements of the City of Madison and Town of Middleton Cooperative Plan approved pursuant to Section 66.0307, Wisconsin Statutes;
 
NOW, THEREFORE, the Common Council of the City of Madison do ordain as follows:
 
1.      Subsection (564) of Section 15.01 of the Madison General Ordinances is hereby created
to read as follows:
 
"15.01(564) - There is hereby attached to the 9th Aldermanic District, the City of Madison, Dane County, Wisconsin, the following described property:
 
Part of the East Half of the NE 1/4 of Section 29, T07N, R08E, Town of Middleton, Dane County, Wisconsin, more particularly described as follows:
 
Beginning at the Northeast Corner of said Section 29; thence S00º00'28"W along the East line of said Section 29, 50.00 feet to the South right-of-way line of Mineral Point Road (County Trunk Highway "S"); thence S89º43'22"W along said right-of-way, 350.36 feet; thence S00º08'27"W, 284.08 feet; thence N89º43'22"E, 351.02 feet to the East line of said Section 29; thence S00º00'28"W along said East line, 2312.64 feet to the East Quarter Corner of said Section 29; thence S89º23'52"W along the East-West Quarter Line of said Section 29, 1326.43 feet; thence N00º05'11"E, 2604.26 feet to the South right-of-way line of Mineral Point Road; thence N00º05'11"E, 50.00 feet to the North line of said Section 29; thence N00º05'11"E (more or less), 50.00 feet to the North right-of-way line of Mineral Point Road; thence N89º43'22"E along last said right-of-way, 1322.65 feet (more or less) to the East line of Section 20, T07N, R08E; thence S00º00'28"W (more or less) along said East line, 50.00 feet to the point of beginning. 2.      Subsection (145) of Section 15.02 entitled "Wards and Ward Boundaries" of the Madison General Ordinances is created to read as follows:
 
"(145)      Ward 145.  Part of the East Half of the NE 1/4 of Section 29, T07N, R08E, Town of Middleton, Dane County, Wisconsin, more particularly described as follows:

3.      Subsection (9) entitled "Ninth Aldermanic District" of Section 15.03 entitled "Aldermanic Districts" of the Madison General Ordinances is amended to read as follows:
 
"(9)      Ninth Aldermanic District. Wards 79, 80, 81, 82, 83, 100, 101, 104, 105, 109, 110, 112, 113, 119, 120, 127, 129, 132, and 141, and 145."
 
4.      If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.
