AMENDED - Amending Sections 28.08(2)(b)8.j., 28.08(9)(b)7.c., 28.08(11)(b)7.i. and 28.08(12)(b)2. of the Madison General Ordinances to allow the keeping of chickens within 2-family detached dwellings in residential districts of four chickens in residential districts on a zoning lot with up to four dwelling units.

DRAFTER’S ANALYSIS: This amendment allows chickens to be kept in all residential districts on lots without a restriction as to type of dwelling. Each dwelling unit is limited to four (4) chickens, so the maximum number of chickens on a lot is eight. The permit application will not be processed unless the permit applicant checks a box, stating that the applicant has the permission of the property owner to keep chickens on the lot.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subparagraph j. of Paragraph 8. of Subdivision (b) entitled “Permitted Uses” of Subsection (2) entitled “R1 Single-Family Residence District” of Section 28.08 entitled “Residence Districts” of the Madison General Ordinances is amended to read as follows:
“j. Keeping of up to four (4) chickens per dwelling unit on a lot with up to four dwelling units, provided that:
i. The principal use is a single-family dwellingNo more than eight (8) chickens are permitted on a lot.
iii. No person shall keep any rooster.
iiiii. No person shall slaughter any chickens.
iviii. The chickens shall be provided with a covered enclosure and must be kept in the covered enclosure or a fenced enclosure at all times.
viv. No enclosure shall be located closer than twenty-five (25) feet to
any residential structure on an adjacent lot.
viv. The owner, or operator, or tenant obtains a license under Sec. 9.52, MGO.
vi. The applicant for a license notifies all residents within two hundred (200) feet of the lot.
vii. Not more than fifty percent (50%) of the residents notified in vi. above object within fourteen (14) days of notification.”
2. Subparagraph c. of Paragraph 7. of Subdivision (b) entitled “Permitted Uses” of Subsection (9) entitled “R4L Limited General Residence District” of Section 28.08 entitled “Residence Districts” of the Madison General Ordinances is amended to read as follows:
“c. Keeping of up to four (4) chickens per dwelling unit on a lot with up to four dwelling units, provided that:
i. The principal use is a single-family dwellingNo more than eight (8) chickens are permitted on a lot.
iii. No person shall keep any rooster.
iiiii. No person shall slaughter any chickens.
iviii. The chickens shall be provided with a covered enclosure and must be kept in the covered enclosure or a fenced enclosure at all times. (Am. by Ord. 13,698, 9-29-04)
viv. No enclosure shall be located closer than twenty-five (25) feet to any residential structure on an adjacent lot.
