Amending Sections 38.06(11) and (12) of the Madison General Ordinances to clarify exemptions related to alcohol beverage service and entertainment licenses.

DRAFTER’S ANALYSIS: This ordinance amendment clarifies that a caterer that has contracted with a venue for exclusive alcohol beverage service is not required to obtain an entertainment license for that same venue.

The Common Council of the City of Madison do hereby ordain as follows:
1. Paragraph 1. entitled “Exemptions” of Subdivision (a) entitled “Entertainment License Required” of Subsection (11) entitled “21 + Entertainment License” of Section 38.06 entitled “General Provisions and Hours” of the Madison General Ordinances is created as follows:
“1. Exemptions . A caterer who has contracted with a venue to provide exclusive alcohol beverage service to the venue shall not be required to obtain an entertainment license for that venue. Entertainment venues that contract with outside vendors to provide alcohol beverage service to the venue are required to obtain an entertainment license if the venue provides live entertainment.”
2. Paragraph 2. entitled “Exemptions” of Subdivision (b) entitled “License Required” of Subsection (12) entitled “18 + Centers for Visual and Performing Arts” of Section 38.06 entitled “General Provisions and Hours” of the Madison General Ordinances is amended as follows:
“2. Exemptions .
i. Performance venues holding theater licenses pursuant to Section 9.04 of the Madison General Ordinances shall not be required to obtain a center for the visual and performing arts license.
ii. A caterer who has contracted with a venue to provide exclusive alcohol beverage service to the venue shall not be required to obtain an entertainment license for that venue. Entertainment venues that contract with outside vendors to provide alcohol beverage service to the venue are required to obtain an entertainment license if the venue provides live entertainment.”
