Authorizing the Mayor and City Clerk to execute an amendment to the lease with Boys and Girls Club of Dane County, Inc. ("BGCDC") providing for a reduction in the area leased to BGCDC for parking lot purposes within the City greenway adjacent to BGCDC's property at 4619 Jenewein Road.
Body
WHEREAS, the City and BGCDC are parties to a lease, dated July 15, 2005 (the "Lease"), providing for BGCDC's use for parking lot and driveway purposes of a portion of the City greenway adjacent to BGCDC's property at 4619 Jenewein Road, as depicted on attached Exhibit B (the "Leased Premises"); and
 
WHEREAS, the CDA is planning to redevelop lands located immediately west of the Leased Premises and desires to use a portion of the Leased Premises not improved with the paved parking lot and driveway for such redevelopment purposes; and
 
WHEREAS, the parties have agreed to amend the Lease to more precisely describe the Leased Premises so as to exclude those lands along the westerly limits of the Leased Premises not improved with pavement; and
 
WHEREAS, the City Engineering Division recently had the parking lot surveyed and a new legal description and map of the Leased Premises have been prepared; and
 
WHEREAS, the Office of Real Estate Services has prepared an amendment to the Lease for the purpose of incorporating the new legal description and map into the Lease, and BGCDC has approved and executed the amendment.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are authorized to execute an amendment to the lease with Boys and Girls Club of Dane County, Inc. dated July 15, 2005 (the "Lease"), amending the Lease as follows:
 
1.      Exhibit B (Page 1 of 2) to the Lease is hereby amended to delete the following note appearing at the top of the page:
 
"Note:      Approximate dimensions of Leased Premises are 100' x 264'. (South boundary line is located midway between edge of parking lot pavement and basketball court.)"
 
2.      Exhibit B (Page 1 of 2) to the Lease is hereby further amended to include the following new note:
 
"Note:       The map below depicts the general location only of the Leased Premises. The legal description and a detailed map of the Leased Premises are contained in attached Exhibit C and attached Exhibit D, respectively."
 
3.      Exhibit C attached hereto is hereby inserted in the Lease.
 
4.      Exhibit D attached hereto is hereby inserted in the Lease.
 
5.      All other provisions of the Lease remain unchanged and in full force and effect.
 
BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute, deliver and record such documents and to take such other actions as shall be necessary or desirable to accomplish the purposes of this Resolution.
