Fiscal Note

The proposed resolution authorizes agreements with the City of Fitchburg, Dane County, and the Wisconsin Department of Transportation for the implementation of North-South BRT on streets under the respective municipality/agency’s jurisdiction. Cost participation by these entities is being negotiated separately and any amounts are included in the Transportation Department capital budget or in future capital requests, subject to Council approval.

Entering into Agreements with the City of Fitchburg, Dane County, and the Wisconsin Department of Transportation for the implementation of North-South Bus Rapid Transit on State and County Highways

Body

WHEREAS, the North South Bus Rapid Transit (N-S BRT) project is in Project Development and has been recommended for funding in the Federal Transit Administration’s Small Starts program; and

 

WHEREAS, portions of the Locally Preferred Alternative for the N-S BRT travel on County Highway D (Fish Hatchery Road in Fitchburg), US Highway 151 (Park Street, East Washington Ave), and State Highway 113 (Packers Ave and Northport Drive); and

 

WHEREAS, Third-Party Agreements are required by the Federal Transit Administration for implementing BRT on streets not under direct jurisdiction of the transit agency/municipality; and

 

WHEREAS, City staff have been in negotiations with representatives from Fitchburg, Dane County, and the Wisconsin Department of Transportation and they are agreeable to implementing bus rapid transit on these roadways; and

 

WHEREAS, Draft Agreements have been drafted and are available for review; and

 

WHEREAS, cost participation by Fitchburg, Dane County, and the Wisconsin Department of Transportation are being negotiated separately in the respective Capital Budgets of Madison and Fitchburg; and

 

NOW, THEREFORE, BE IT RESOLVED that the City Attorney is authorized to approve in form Third-Party Agreements with Fitchburg, Dane County, and the Wisconsin Department of Transportation for the purposes set forth herein; and

 

BE IT FURTHER RESOLVED that the Mayor, the Finance Director, and City Clerk are authorized to enter into such Agreements with Fitchburg, Dane County, and the Wisconsin Department of Transportation for the planning, installation, maintenance, and operation of N-S BRT.

 

BE IT FURTHER RESOLVED that the Mayor, the Finance Director, and City Clerk are authorized to sign related documentation for the purposes of legal, regulatory, and grant compliance in a form approved by the City Attorney.
