Fiscal Note
$1000.00 administrative fee ($500 each for the new easement and $500 for the easement release) to be paid to the Real Estate Department out of the American Family Mutual Insurance Company deposit monies available in Water Utility Account No. EW01-58130-810455.
Title
Authorizing the Mayor and City Clerk to accept Public Water Main easements located within Lots 1 and 2, The American Center Plat, and to execute the partial release of a Public Water Main Easement located in Lot 2, the American Center Plat.
 
Body
WHEREAS, in 1998 the American Family Mutual Insurance Company constructed  water main facilities to serve the headquarters buildings in accordance with City Engineering Division Project No. 53B1676 ; and
 
WHEREAS, at the time of construction, it was understood and the parties agreed that the water main facilities would be operated and maintained by the City of Madison Water Utility, however, the necessary documents were not processed; and
 
WHEREAS, The American Family Mutual Insurance Company has provided the necessary legal descriptions and maps of the as-built water main; and
 
WHEREAS, the City of Madison Engineering Division has reviewed the documents and recommends acceptance of the easements and release of the platted easement where no facilities exist.
 
NOW, THEREFORE, BE IT RESOLVED, that the City of Madison is hereby authorized both to accept the easement for Public Water Main purposes where facilities exit and release the platted easement where facilities do not exist, at no cost to the City of Madison.
