DRAFTER'S ANALYSIS: This ordinance detaches .24 acres of land from the 11th Aldermanic District.

An ordinance to create Subsection (597) of Section 15.01 of the General Ordinances of the City of Madison entitled “City Boundaries” and being part of the chapter entitled “Aldermanic Districts and Wards”.
WHEREAS on April 30, 2015, a Notice of Intention to Circulate a Petition of Detachment was published in the Wisconsin State Journal as required by Wis. Stat. § 66.0227(1); and
WHEREAS, on June 22, 2015, a Petition for Detachment (the “Petition”) of the Territory, described in Exhibit A and shown on Exhibit B, both attached hereto, was filed in the Office of the City Clerk of the City of Madison (“Madison”); and
WHEREAS, a revised petition was filed with the Office of the City Clerk on June 29, 2015 to correct the description of the property; and
WHEREAS, said Petition has been signed by a majority of the owners of three-fourths of the taxable land in area within the Territory proposed to be detached; and
WHEREAS, pursuant to Wis. Stat. § 66.0227(2), the Village of Shorewood Hills shall, by duly adopted ordinance, attach the Territory within sixty (60) days of the detachment of the Territory from the City of Madison or this ordinance shall be void.
NOW, THEREFORE, the Common Council of the City of Madison do ordain as follows:
1. Subsection (597) of Section 15.01 of the Madison General Ordinances is hereby created to read as follows:
"15.01(597) - There is hereby detached from the 11th Aldermanic District, the City of Madison, Dane County, Wisconsin, the following described property:
That part of the SE 1/4 of the SW 1/4 of Section 17, T7N, R9E, in the City of Madison, Dane County, Wisconsin, more particularly described as follows:
Commencing at the South 1/4 of Section 17, T7N, R9E, Dane County, Wisconsin, thence N00°10'12"E, along the North-South 1/4 line of said Section 17, 577.91 feet to the point of beginning of this description; thence 523.47 feet along the arc of a 17137.47 radius curve to the left with a chord bearing S81°35'19"W, 523.45 feet, and a delta angle of 01°45'00"; thence N00°13'11"E, 17.28 feet; thence 523.59 feet along the arc of a 5695.65 radius curve to the right with a chord bearing N81°36'55"E, 523.40 feet, and a delta angle of 05°16'01", said arc being the southerly most arc as described in Document 3262259; thence S00°10'12"W, along said North-South 1/4 line, 17.03 feet to the point of beginning. Said described area contains 10,279 square feet, or 0.24 acres, or 0.000375 square miles.”
2. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.
EDITOR'S NOTE: Pursuant to Wis. Stat. § 66.0227(2), this detachment ordinance must be enacted by a three-fourths vote of the elected members of the Common Council or at least 15 votes.
