Amending Section 10.056(5)(e) of the Madison General Ordinances to clarify that time limits for sound amplification equipment which is approved as part of a Street Use Permit shall be determined by the Street Use Staff Team.

DRAFTER'S ANALYSIS: This ordinance amendment would allow the sponsor of an event to use amplified sound after 11:00 p.m., if approved as part of the Street use Permit. Under the current street use ordinance, the times and use of amplified sound are determined as part of the conditions of the permit between the hours of 10:00 am. and 11:00 p.m. This amendment would allow amplified sound after 11:00 p.m. if the applicant follows notification procedures and additional findings are made.

The Common Council of the City of Madison do hereby ordain as follows:
Subdivision (e) entitled "Sound Amplification" of Subsection (5) entitled "Application Process and Permit Requirements" of Section 10.056 entitled "Street Use Permit" of the Madison General Ordinances is amended to read as follows:
"(e) Sound Amplification. The use of sound amplification equipment may be approved as part of the Street Use Permit; and if approved, a separate permit under sec. 24.04(3) shall not be required. Any applicable time limits in sec. 24.04(3) shall not apply to a Street Use Permit. The Staff Team shall determine the times and conditions for use of amplified sound using the standards of issuance herein, except that the use of sound amplification equipment may only be approved between 10:00 a.m. and 11:00 p.m. Requests for sound amplification after 11:00 p.m. may be considered and granted by the Staff Team if the Notification or petition required under sec. 10.056(5)(g) described the proposed hours for amplification; and if the Staff Team makes a specific finding that the Standards of Issuance, including sub. (6)(i), will not be violated by the use of amplified sound after 11:00 p.m. Any applicable time limits in sec. 24.04(3) shall not apply to a Street Use Permit issued under Sec. 10.056. "
