DRAFTER'S ANALYSIS:  This amendment is to update certain MGO's to remove references to the Director of Revenue and charge the Treasurer and Clerk, respectively, with the specified duties.

The Common Council of the City of Madison do hereby ordain as follows:
1.      Subsection (3) of Section 4.16 entitled "Reserve Fund" of the Madison General Ordinances is amended to read as follows:
"(3)      The Director of RevenueCity Treasurer shall, from time to time, recommend to the Common Council the investment of said fund, or part thereof, as it accrues. Disbursements, investments, sale or transfer of any securities held in said fund shall be, by resolution of the Common Council, on checks or City orders, signed by the Mayor, the City Clerk and the City Treasurer."
2.      Subsection (6) of Section 4.16 entitled "Reserve Fund" of the Madison General Ordinances is amended to read as follows:
"(6)      The City Treasurer shall keep all cash on hand, belonging to said reserve fund, in a separate account in one of the depositories in the City of Madison as shall be designated by the Director of Administration. The said Director of RevenueCity Treasurer shall also designate a suitable, safe depository, wherein the City Treasurer shall keep all bonds, or other securities, in which said fund shall be invested."
3.      Subsection (3) of Section 9.01 entitled "Duty Of Clerk With Regard To Licenses; Payment Of Taxes, Claims, Forfeitures, Judgments, Etc., Appeal" of the Madison General Ordinances is amended to read as follows:
"(3)      Alleged errors in amounts claimed to be due the City may be appealed to a committee comprised of the Assessor, the Director of RevenueCity Treasurer and the Comptroller or their designees. The committee shall have no authority to review any matter for which a review or appeal procedure has been provided by statute or other ordinance. Within five (5) days of being informed of an amount claimed due, the person seeking review shall pay the amount claimed and file a written notice of appeal with the Clerk stating the bases for the appeal and specifying the alleged error. Upon payment, the applicant may file the application for the license or permit if otherwise qualified. As soon as practicable, the committee shall hold a hearing at which the person shall present evidence to substantiate the claimed error, call witnesses in his/her own behalf, may cross-examine witnesses and may be represented by legal counsel. After holding the hearing, the committee shall by majority vote make findings of fact and conclusions and shall correct any established errors. Any amount improperly required paid shall be refunded promptly, together with interest at the rate of twelve percent (12%) per annum from the date the amount was paid to the City to the date of refund."
4.      Subsection (5) entitled "Administrative Review Board" of Section 9.49 entitled "Review Of Administrative Determinations" of the Madison General Ordinances is amended to read as follows:
"(5)      Administrative Review Board. There is hereby created an Administrative Review Board, consisting of five (5) persons, appointed by the Mayor, and approved by the Common Council. When this Board is first constituted, three (3) members shall be appointed for terms of two (2) years and two (2) members shall be appointed for terms of one (1) year. Thereafter, members shall serve for terms of two (2) years. The Board shall elect a President and Secretary and may adopt rules of procedure. The Director of RevenueCity Clerk shall provide staff support to the Board."
