Title

Authorizing the City of Madison to accept ownership from the Bram’s Addition Neighborhood Association of a neighborhood entrance sign to be located in the public right-of-way near the intersection of S. Park Street and Beld Street.

Body

WHEREAS, the Bram’s Addition Neighborhood Association (“the Association”) has requested permission to install a neighborhood entrance sign (the “Sign”) within the public right-of-way near the intersection of S. Park Street and Beld Street; and

 

WHEREAS, the Association will transfer ownership of the Sign to the City after installation, in exchange for the ongoing maintenance and repair of the Sign by the Association, as set forth in a Letter of Agreement (the “Agreement”) to be executed by the City and the Association; and

 

WHEREAS, City staff from the Offices of the City Attorney, Engineering, Traffic Engineering, Risk Management, Planning, Real Estate and Metro Transit Utility have reviewed this Privilege in Streets application and approved it with conditions to be contained within the Agreement; and

 

WHERAS, the design of the Sign is illustrated on attached Exhibit A and the location of the Sign is depicted on attached Exhibit B.

 

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison authorizes the acceptance of ownership from the Bram’s Addition Neighborhood Association of a neighborhood entrance sign to be located in the public right-of-way near the intersection of S. Park Street and Beld Street as illustrated on attached Exhibit A and depicted on attached Exhibit B; subject to the following conditions:

 

1.                     The Association shall be responsible for all costs of installation, maintenance and repair of the Sign.

 

2.                     The Sign shall be located within a 12’ x 20’ rectangular area as depicted on attached Exhibit B.  The west edge of the rectangle being parallel and ten feet from back of the S. Park Street sidewalk. The north edge of the rectangle being parallel and thirty feet south of the Beld Street face of curb.

 

3.                     The Association shall contact Diggers Hotline to locate all underground utilities in the area where the Sign is to be installed prior to any excavation or construction activities.

 

4.                     The Association shall comply with all Madison General Ordinances regarding permits required for the construction and installation of the Sign within the public right-of-way, including but not limited to a City Engineering Permit to Excavate in the right-of-Way.

 

5.                     The Association shall agree that the City shall not be held responsible for any damage to the Sign that may be caused by the City, its employees, contractors, or others.

 

6.                     The City may remove the Sign if not properly maintained, by giving the Association sixty (60) days written notice prior to removal. 

 

7.                     The City may remove the Sign if the area occupied by the Sign is required for transportation or other public purposes, by giving the Association sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
