Fiscal Note

The proposed resolution authorizes an agreement with the State of Wisconsin Department of Transportation for construction of a new pedestrian and bicycle path on Madison’s east side (the Garver Path). The 2019 Executive CIP anticipates construction of the Garver Path in 2021; the total project cost is $1.85 million. As assumed in the 2019 Executive CIP, construction of the project will be evenly funded by GO borrowing and federal sources. The federal funds have been secured through the Local Let Transportation Alternatives Program (TAP).

PREAMBLE

 

The City of Madison Engineering Division is proposing a new pedestrian & bicycle path, called the Garver Path along the north east side of the City, generally located around the Wisconsin & Southern Rail Road Corridor.  The Garver Path includes a new path from the Capital City Trail near Sugar Avenue along a new alignment to Milwaukee Street.  The path includes two new bridges across the Starkweather Creek & a new boardwalk structure over wetlands in O.B. Sherry Park. 

 

The project was awarded a federal grant under the Transportation Alternatives Program (TAP) that will reimburse 50% of participating construction costs to a maximum of $850,000.  The proposed project is planned for construction in 2021.  The City is responsible for 100% of the design and design review costs.

 

The agreement requires that the City indemnify the State of Wisconsin Department of Transportation.  City APM 1-1 requires Common Council Approval whenever the City indemnifies another party. 

 

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute an agreement with the State of Wisconsin Department of Transportation for construction, construction oversight and cost sharing for the Garver Path project.

 

BE IT FURTHER RESOLVED, that the Common Council approves indemnification of the State of Wisconsin Department of Transportation as set forth in the agreement in order to use federal funds for the Garver Path project.
