PREAMBLE
 
The State of Wisconsin, Department of Administration and the University of Wisconsin-Madison are in the process of upgrading underground utility systems across campus and will be working along and in the Murray Street right-of-way, from West Dayton Street north to Lake Mendota, in several phases during 2008. The project includes the need to do work in the University Avenue, West Johnson Street and West Dayton Street intersections within the Murray Street right-of-way. The overall utility upgrade project is scheduled to be complete in the Fall of 2010 with the work in the above intersections completed by September 2, 2008. It is anticipated that the work shall be done in two weekends unless there are unforeseen circumstances beyond the control of the Contractor or there are weather related delays. The work of this project cannot be constructed between the hours of 7:00 AM and 7:00 PM because:
 
1.      Operation of construction machinery will block travel lanes and impede traffic. Completing the work at night allows for the least amount of disruption to normal daily traffic.
 
2.      Certain construction activities will require several hours to complete and cannot be completed without impeding access to at least one lane of traffic in University Avenue, West Johnson Street and West Dayton Street during periods of the work.
 
The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:
 
1.      Works includes saw cutting concrete street pavement, concrete breaking with pneumatic jack hammers for portions of pavement (major sections will be lifted out by crane), removal of a portion of steel pilings, soil excavating, portable generators for lighting, soil compaction, concrete placement and finishing. Trucking to haul materials and spoils will also be included.
 
2.      Work will be between the hours of 9:00 PM and 6 AM weekdays and 9:00 PM Friday to 6:00 AM Monday mornings on weekends. Work will not be done on Art Fair weekend of July 12 and 13.
 
3.      Work will begin May 23, 2008 and be complete on or before September 2, 2008.
Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances.  Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities, with associated noise impacts, outside of the hours of 7:00 AM to 7:00 PM. with the passage of a resolution.  
 
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on University Avenue, West Johnson Street and West Dayton Street are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and
 
BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution and are limited to the hours specified, and
 
BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on September 2, 2008.
