Title
Determining a Public Purpose and Necessity and adopting a Transportation Project Plat Number. 5992-10-73, City of Madison, High Point Rd - Raymond Rd Intersection for the acquisitions per the Plat of Land and Interests required. Located in the Northeast 1/4 of the Northwest 1/4, the Southeast 1/4 of the Northwest 1/4, the Southwest 1/4 of the Northwest 1/4, and the Northwest 1/4 of the Northwest 1/4 of Section 2, Township 6 North, Range 8 East, in both the Town of Verona and the City of Madison, Dane County, Wisconsin. (District 1, District 7)
Body
WHEREAS, the City of Madison (“City”) and the Wisconsin Department of Transportation (“WisDOT”) have proposed a project to construct S High Point Road from the southern boundary of the Mid Point Meadows Plat to Raymond Rd and reconstruct the existing intersection of S High Point Rd and Raymond Rd (hereinafter the “Construction Project”); and,
WHEREAS, the City’s Engineering Division has established Project Number 12454 for the design and administration of the Construction Project; and,
WHEREAS, the City’s Common Council adopted an amendment to Section 16.24 IV of the Madsion General ordinances adding descriptions to areas of the Official Map in Ordinance 2091 approved on August 19, 1966 which contained reservations for a North-South running Public Street connecting to Raymond Road. The proposed alignment of the proposed right of way to be acquired per this Transportation Project Plat conforms with the said officially mapped street location; and
WHEREAS, the City’s Future Land Use and Street Plan map of the High Point-Raymond Neighborhood Development Plan, adopted by the City of Madison Common Council on August 1, 2017, File ID No. 47681, shows a collector street connection of S High Point Road from Mid Town Road to Raymond Road. The alignment of the proposed right of way to be acquired per this Transportation Project Plat conforms with the said Neighborhood Development Plan collector street location; and
WHEREAS, the City’s Common Council adopted RES-24-00630, File ID 85460 on October 29, 2024, authorizing the Mayor and the City Clerk to execute a contract between the City and MSA Professional Services, Inc. for design engineering services for the Construction Project; and,
WHEREAS, the City’s Common Council adopted RES-24-00672, File ID 85818 on November 26, 2024, authorizing the Mayor and City Clerk to execute a State/Municipal Agreement with WisDOT for Project I.D. 5992-10-73/74: High Point Road for construction cost sharing; and,
WHEREAS, the City’s Common Council adopted RES-25-00513, File ID 89697 on October 07, 2025, approving roadway geometry for the Construction Project; and,
WHEREAS, Legistar File ID 90224 was introduced to the City’s Common Council authorizing the Mayor and the City Clerk to execute an Amendment to the contract between the City and MSA Professional Services, Inc. for additional design engineering services for S High Point Rd pending final action on October 28, 2025; and,
WHEREAS, the City’s Office of Real Estate Services of the Economic Development Division has established a Master File / Project No. 13021 to facilitate and administer the land and land interest acquisitions required for the Construction Project as identified in Relocation Order - Transportation Project Plat Number 5992-10-73 prepared by MSA Professional Services Inc.; and,
WHEREAS, the Design Study Report (“DSR”) approval by the WisDOT Southwest Region Project Development Section Local Program Project Manager for the Construction Project is pending final approval; and,
WHEREAS, a copy of the Relocation Order - Transportation Project Plat Number Transportation Project Plat Number 5992-10-73 is attached hereto and made part of this resolution.
NOW THEREFORE BE IT RESOLVED, that the City of Madison, Dane County, Wisconsin, by its Common Council and for its Relocation Order hereby resolves as follows:
1. That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the public acquisition Construction Project and that this acquisition is determined to be necessity in accordance with Section 32.07(2), Wisconsin Statutes, and the acquisition shall allow for the construction of planned public improvements for the Construction Project.
2. That the City hereby determines that it is necessary, and a public purpose exists to acquire necessary land and land interests from the properties/parties as identified in the Schedule of Lands & Interests on the attached Transportation Project Plat Map and such acquisitions are required to allow for the construction of said public improvements.
3. That the City’s Common Council does hereby adopt this relocation order to acquire the necessary land and land interests required for the construction of planned public improvements associated with Engineering Division Project Number 12454, City of Madison, High Point Rd - Raymond Rd Intersection, consisting of the attached Transportation Project Plat maps in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes. The final approval of this relocation order and subsequent execution of the approval certificates on the Transportation Project Plat are hereby contingent upon the DSR being approved. The approval certificates on Transportation Project Plat 5992-10-73 shall be executed only upon the satisfaction of this contingency, followed by the recording of the Transportation Project Plat sheets in the office of the Dane County Register of Deeds.
4. That the City’s Office of Real Estate Services of the Economic Development Division and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Transportation Project Plat and any Uneconomic Remnant (Section 32.05(3m) of the Wisconsin Statutes) that may be subsequently determined to exist by the City. Also, the City’s Office Real Estate Services is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisitions necessary for the Construction Project.
5. That the City’s Office of Real Estate Services Division of the Economic Development Division staff shall administer the acquisition of all land and land interests by Real Estate Master Project No. 13021.
6. That the City’s Office of Real Estate Services of the Economic Development Division is hereby authorized to execute any potential Jurisdictional Offers, Lis Pendens, and Awards of Compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary.
7. That the Mayor and City Clerk are authorized to sign all necessary documents to accomplish the acquisitions necessary for the Construction Project.
