These new grants provide $35,000 ($10,000 in 2016 and $25,000 in 2017) to MPD for overtime wages to deploy officers for Internet Crimes Against Children (ICAC) enforcement activities (MUNIS 3110020-51320). There is no matching requirement, however, the grant does not cover the benefits associated with the overtime so the 2016 benefit costs will be absorbed by MPD’s existing 2016 operating budget. The MPD 2017 Executive Operating Budget will reflect the funding for the 2017 grant.

Authorizing the Madison Police Department to accept public safety funds of up to $10,000 in 2016 and $25,000 in 2017 from the Wisconsin Department of Justice - Division of Criminal Investigation for overtime wage expenses for Internet Crimes Against Children investigations; and amend budgets accordingly

WHEREAS, on April 19, 2016, 2015 Wisconsin Act 369, known as “Alicia’s Law,” was signed by the Governor in order to assist Wisconsin’s Internet Crimes Against Children (ICAC) Task Force with conducting criminal investigative operations and to increase public awareness and prevention of ICAC offenses; and
WHEREAS, $1 million was dedicated to the Wisconsin ICAC Task Force, to be managed by the Wisconsin Department of Justice - Division of Criminal Investigation (DCI), which is the “lead” ICAC Task Force agency in the State of Wisconsin and the agency that manages Wisconsin’s ICAC Task Force; and
WHEREAS, the policy objectives for the ICAC Task Force Program are to: increase the investigative capabilities, including the effectiveness and efficiency, of law enforcement officers in the detection, investigation of qualifying offenses and the apprehension of offenders; conduct proactive and reactive ICAC investigations; increase the number of ICAC (state and federal) offenses being prosecuted; create a multi-agency task force response to ICAC offenses; enhance the nationwide response to ICAC offenses; and develop and deliver ICAC public awareness and prevention programs; and
WHEREAS, in the spirit of Alicia’s Law, DCI will provide reimbursement to Wisconsin ICAC Task Force affiliate agencies for overtime which is incurred and is directly related to ICAC enforcement activities and operations, including search warrants and consent searches, “traveler” and child sex trafficking operations, arrest operations, and other undercover operations; and
WHEREAS, the purpose and goal is to allow ICAC Task Force affiliate agencies the ability to investigate ICAC cases as quickly as possible (and as a result, allow agencies to work more/additional investigations) by providing reimbursement for overtime expenses for agency personnel; and
WHEREAS, the Madison Police Department became a member of the ICAC Task Force in February 2016 and has received 25 ICAC tips directly from DCI to date; and
WHEREAS, the Department also has other Internet Crimes Against Children cases that would be eligible for this overtime wages reimbursement.
NOW THEREFORE BE IT RESOLVED that the Madison Police Department is authorized to accept these public safety funds of up to $10,000 in 2016 and $25,000 in 2017 from the Wisconsin Department of Justice - Division of Criminal Investigation.
BE IT FURTHER RESOLVED that up to $10,000 will be used for overtime wage expenses for Internet Crimes Against Children investigations.
BE IT FURTHER RESOLVED that MPD will pay for overtime benefits out of its authorized operating budget.
BE IT FINALLY RESOLVED that the Finance Director and the Police Department are authorized to establish and/or maintain segregated accounts as required for the administration of these funds; and amend budgets accordingly.
