DRAFTER'S ANALYSIS:  This ordinance creates a fee for burn permits and increases fees for licenses issued for recharging fire extinguishers and permits for the sales of recreational fireworks by removing current language in Secs. 34.28(2)(c) and 34.32(2), the fees for licensing under these respective subsections will be set at $100 pursuant to the default language in Sec. 34.04(6).

The Common Council of the City of Madison do hereby ordain as follows:
1.      New Subsection (8) of Section 34.04 entitled "Licenses and Permits" of the Madison General Ordinances is created to read as follows:
"(8)      Open burning permit ($50)"
2.      Current Subsections (8) through (11) of Section 34.04 entitled "Licenses and Permits" of the Madison General Ordinances are renumbered Subsections (9) through (12), respectively.
3.      Subdivision (c) of Subsection (2) entitled "Recharging of Extinguishers" of Section 34.28 entitled "Fire Extinguishers" of the Madison General Ordinances is amended to read as follows:
"(c)      Such license shall be issued on the first (1st) day of July each year, or thereafter when applied for, and shall expire on the thirtieth (30th) day of June following its issuance. There shall be a charge of fifty dollars ($50) for the issuance of each license to recharge extinguishers. "
4.      Subsection (2) entitled "retail Sales and Permits" of Section 34.32 entitled "Recreational Fireworks" of the Madison General Ordinances is amended to read as follows:
"(2)      Retail Sales and Permits.  The following requirements are in addition to the requirements in IFC Section 3301.2     
(a)      A permit is required for the retail sales of recreational fireworks. All retailers, before selling or offering to sell recreational fireworks shall obtain a permit from the Chief. The permit shall be valid for no longer than one year. A permit shall not be issued to a minor who is under the age of eighteen (18) years of age.  
(b)         An application for a permit for the sales of recreational fireworks shall be made in writing at least thirty (30) days in advance of the sale or offer to sell, and shall specify:  
1.   The name and address of the permit holder;  
2.   The date on and after which sales or offers to sell shall be made;  
3.   The kind, quantity, and location of each device to be offered for sale.  
(c)         The fee for a permit is fifty dollars ($50) at the time of application.  
      (d)(c)      No permit granted hereunder shall be transferable.  
(e)(d)      Retail sales of recreational fireworks is limited to those items as defined in this chapter."
