Title: Creating new Section 12.128(16), renumbering current Section 12.128(16) to Section 12.128(17), respectively, amending Section 12.141(2), and amending Section 1.08(3)(a) of the Madison General Ordinances to deter parking in front of and in close proximity to mailboxes located near the roadway.

Creating new Section 12.128(16), renumbering current Section 12.128(16) to Section 12.128(17), respectively, amending Section 12.141(2), and amending Section 1.08(3)(a) of the Madison General Ordinances to deter parking in front of and in close proximity to mailboxes located near the roadway.
Body
DRAFTER'S ANALYSIS:  This subsection is being created to deter parking in front of and in close proximity to mailboxes, which face the roadway and are equipped to receive mail from postal vehicles while operating on the roadway.  This ordinance is being created in an effort to prevent the obstruction of mail delivery.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      New Subsection (16) entitled "Parking within Four (4) Feet of a Mailbox Prohibited" of Section 12.128 entitled "Miscellaneous Restrictions on Parking" of the Madison General Ordinances is created to read as follows:
"(16)      Parking within Four (4) Feet of a Mailbox Prohibited.  No person shall stop, stand or park a vehicle within four (4) feet on either side of a mailbox which is placed and equipped for the purpose of depositing mail from vehicles on the roadway, except:
(a)      Temporarily stopped for the purpose of and while actually engaged in loading or unloading or receiving or discharging passengers and while attended by a licensed operator so that it may be moved in case of an emergency or to allow for the delivery of mail;
(b)      When a person is stopping, standing or parking a vehicle within four (4) feet of their own mailbox, provided that while doing so, the person is not within four (4) feet of another person's mailbox.
(c)       Temporarily stopped for the purpose and while actually engaged in the delivery of mail or newspapers."
      2.      Current Subsection (16) of Section 12.1335 of the Madison General Ordinances is renumbered to Subsection (17).
      3.        Subsection (2) of Section 12.141 entitled "Penalties For Violating Sections 12.122 Through 12.140" of the Madison General Ordinances is amended to read as follows:
"(2)      Any person violating Section 12.128(5), 12.128(16), 12.1334(99), 12.1335 or 12.1336 shall be subject to a forfeiture of not less than five dollars ($5) nor more than sixty dollars ($60)."
      4.      Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by amending or adding therein the following:  
"No parking within 4 feet of mailbox      12.128(16)                  $20
Successive violations.                  12.128(1617)                  $35"
EDITOR'S NOTE:  New or amended bail deposits must be approved by Municipal Judge prior to adoption.  These deposits have been so approved.
