The proposed resolution authorizes a contract between the City of Madison and Bayview Foundation, Inc. to convey to Bayview Foundation, Inc. up to $2 million of American Rescue Plan Act funds awarded through the State of Wisconsin. Funding will be used to support the Bayview Foundation’s Triangle redevelopment project. This grant was accepted in 2022 through RES-22-00355; however, the resolution failed to explicitly authorize a contract. This resolution provides the necessary authorization for the City to enter into an agreement with Bayview Foundation, Inc. for the purposes for which the grant was awarded. No additional appropriation is required.

Background
On May 10, 2022, the Common Council enacted Resolution No. RES-22-00355, Legislative File No. 70986, authorizing the acceptance of a $2 million grant from the Neighborhood Investment Fund ("NIF") Grant Program awarded to the City by the State of Wisconsin Department of Administration ("DOA") to support the Bayview Foundation's Triangle redevelopment project.
The DOA's NIF Grant Program was launched on August 24, 2021, by Governor Tony Evers, using federal American Rescue Plan Act State and Local Fiscal Recovery Funds ("ARPA-SLFRF") awarded to the State of Wisconsin from the US Department of Treasury pursuant to section 602 of the Social Security Act, as amended by section 9901 of the American Rescue Plan Act of 2021 ("ARPA") to be used for the purposes specified in the ARPA. The State’s NIF Grant Program offers grants to local and Tribal governments for projects to help neighborhoods recover from negative effects of the COVID-19 pandemic, with a particular focus on addressing the needs of residents living in communities disproportionately impacted by the pandemic.
Resolution RES-22-00355 amended the Community Development Division budget to recognize receipt of the NIF Grant and authorized an agreement with the State of Wisconsin, but did not include specific authorization to contract with Bayview Foundation, Inc. via a sub-recipient award.
This Resolution addresses that oversight and provides the necessary authorization for such an agreement between the City and Bayview Foundation, Inc.
Action Item.
WHEREAS, on November 11, 2021, the City of Madison submitted a request to the Wisconsin Department of Administration Neighborhood Investment Fund Grant Program seeking $2 million to support the Bayview Foundations’ Triangle redevelopment project; and,
WHEREAS, the State responded to that request by awarding the City a $2 million grant; and,
WHEREAS, on May 10, 2022, as the Common Council enacted Resolution No. RES-22-00355, Legislative File No. 70986, to accept the award and authorize an agreement between the City and the State of Wisconsin Department of Administration ("DOA"); and,
WHEREAS, RES-22-00355 failed to provide explicit authorization for the City to enter into a contract with Bayview Foundation Inc. to allow funds to be utilized for the intended purpose.
NOW, THEREFORE, BE IT RESOLVED that the Common Council hereby authorizes the Mayor and the City Clerk to enter into an agreement with Bayview Foundation, Inc. for the purpose of conveying up to $2 million of State NIF grant funds to be used for the purposes for which the grant was awarded.
