Approving temporary construction work with associated noise impacts between the hours of 7:00 PM and 7:00 AM for work associated with Verizon Small Cell Facility at 1050 University Ave. (District 8)

PREAMBLE

Concordia Wireless, Inc., working on behalf of their client Verizon, submitted plans and associated documentation and received a small cell permit to install a new small cell facility within the right-of-way, located at 1050 University Ave. (near the intersection of University Ave. & Mills St.) in June of 2021.  Since that time, the ability to coordinate with ongoing work on University Ave. in this area has prevented that facility from being installed.  This installation will include a new pole within the right-of-way, as allowed by State Statute and City Ordinances, along with the necessary equipment, wiring, and underground utility installations. The goal of this permitted work is to improve Verizon wireless service coverage in the area.

 

Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside of the hours of 7:00 AM to 7:00 PM with the passage of a resolution and a hearing before the Board of Public Works. It is anticipated that the Contractor performing this work will call for permission to perform the work required to complete the project outside the hours of 7:00 AM to 7:00 PM because:

 

1.                     Work at this location requires a lane closure on the north side of University Ave. and potentially Park St., which are major transportation routes

2.                     Ongoing work with the UW project (CDIS) already includes a lane closure on the southerly side of University Ave., which will continue for quite sometime

3.                     An additional lane closure on University Ave. during the hours of 7am and 7pm would have major impacts to vehicle, bike and pedestrian traffic and Metro service through downtown

 

The proposed activities beyond the hours of 7:00 AM to 7:00 PM may be as follows:

 

1.                     Removal and replacement of concrete sidewalk

2.                     Installation of conduit and wiring, and associated items for electrical and fiber connections to the small cell facility

3.                     Installation of concrete foundation, new pole, and small cell equipment on the pole

 

 

The planned schedule for the work is from July 22, 2024 until August 22, 2024, and work between the hours of 7pm and 6am will be limited to two weeks (14 calendar days) during this duration.

 

Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances section 24.08 (3) provided the Common Council adopts a resolution allowing the construction.

 

NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on are hereby approved in accordance with Section 24.08(3) of the Madison General Ordinances., and

 

BE IT FURTHER RESOLVED, that the construction activities outside the hours of 7:00 AM and 7:00 PM are limited to those activities identified in this resolution, the hours specified, and the number of occurrences, and

 

BE IT FURTHER RESOLVED, that the Contractor shall provide a written notification for work beyond normal hours to the City Engineer and District 8 Alder at least 72 hours before such work is anticipated, and

 

BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on August 22, 2024.
