PREAMBLE
 
The City of Madison Common Council introduced on December 14, 2006 a Resolution I.D. No. 05264: Approving plans and specifications for the Portage Road (Hanson Road) Overpass and Approaches over I 39/90/94 and authorizing the Mayor and City Clerk to enter into agreements with the Wisconsin Department of Transportation for the work and authorizing the Mayor and City Clerk to enter into an amendment to the present agreement for the subdivision known as the American Center Plat Hanson Addition and Authorizing the Board of Public Works to advertise and receive bids. (17th AD); and
 
Resolution I.D. No. 05264 Approving Plans, Specifications, And Schedule Of Assessments was adopted January 2, 2007 and City Engineering has created Engineering Project No. 53W0189 - Portage Road / Hanson Road Bridge over I 39/90/94; and
 
The Hanson Neighborhood Plan and the Rattman Neighborhood plan call for the realignment of the Portage Road Bridge now traversing the interstate in a north-south direction to an alignment more east-west and in line with Hanson Road.  American Family Insurance has platted the lands east of the interstate consistent with the Rattman Neighborhood Plan and has requested the project to construct a new overpass.  The Wisconsin Department of Transportation has prepared plans for the Portage Road (Hanson Road) Overpass of I 39/90/94 consistent with the neighborhood plans.  
 
The Wisconsin Department of Transportation has agreed to fund the majority of the cost of the bridge, American Family has agreed to construct the east approach to the bridge including a roundabout on the east side.  The City of Madison will construct the west approach and acquire any needed right of way on the west side of the interstate.  The City of Madison will resurface Hanson Road from Portage Road to Manufacturers Drive with the project.  
 
The existing bridge is a narrow 2 lane bridge with no space for bicycles or pedestrians.  Development east of I 39/90 in recent years has increased the need for bike facilities on the bridge and the new alignment of the bridge will better serve the development east of the Interstate.  
 
The proposed plan is to remove the existing bridge and construct a new two lane bridge with bike lanes and sidewalks.  Hanson Road will connect into Eastpark Blvd on the east side and form a tee intersection with Portage Road to the north where a roundabout will be constructed.  A tee intersection will be constructed on the west side where Portage Road from the south will connect with Hanson Road.  
 
The City of Madison contracted with Owen Ayres and Associates to perform all necessary field-surveying operations related to this project. Topographical surveying data was provided to the City of Madison Engineering Division for design purposes. City Engineering then provided Owen Ayres with the limits of necessary land interest acquisition areas to complete the project. Owen Ayres then prepared and provided the City of Madison a Transportation Project Plat ("TPP") in accordance with 84.095 Wi. Stats
 
The "TPP" is titled - Transportation Project Plat No: 53W0189 - 4.01.
 
Land interest acquisitions are required from four (4) properties and release of rights is required from four (4) utilities to complete this construction project.
 
The City of Madison Real Estate Department has created Project No. 8591 - as a master file to administer all necessary land interest acquisitions and release of rights. Eight (8) individual Real Estate projects will be established to secure all land interests required.
 
The construction is planned for 2008 and all land interests and release of rights shall be acquired by August 20, 2007.
 
 
Now Therefore be it resolved that the City of Madison, Dane County, Wisconsin, by its City Council hereby resolves as follows:
 
1.      That this Transportation Project Plat No: 53W0189 - 4.01 in accordance with 84.095, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessity in accordance with Section 32.07(2), Wisconsin Statutes, and the acquisition shall allow for the construction of public improvements related to Engineering Project No. 53W0189 - Hanson Road / Portage Road from Manufacturer Drive to Interstate Highway 39 (I.H. 39);
 
2.      That the City of Madison Real Estate Section of the Community and Economic Development Unit and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Transportation Project Plat, and the Real Estate Section is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition;
 
3.      That the City of Madison Real Estate Section of the Community and Economic Development Unit is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary;
 
4.      That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition;
