The proposed amendment eliminates the Langdon Street High Density Vending Area in the 700-800 blocks of Langdon Street. No street vending license has been issued for this area since 2016, resulting in no fiscal impact for the proposed amendment.

Amending Section 9.13(6)(a) and repealing Sections 9.13(7)(b)1. and (7)(e)2. of the Madison General Ordinances to clarify the State Street Mall/Capitol Concourse Vending Area boundaries and to eliminate the Langdon Street High Density Vending Area.

DRAFTER'S ANALYSIS: This ordinance removes references to the Langdon Street High Density Vending Area. Currently there is a specialized street vending area in the 700-800 blocks of Langdon Street, with a small number of vending sites available for assignment. This amendment eliminates the area and those sites will no longer be available. This amendment also clarifies that the boundary of the State Street Mall/Capitol Concourse Vending Area includes the blocks where the Langdon Street high density area was, and makes a number of housekeeping changes to the description of the Mall/Concourse, but no substantive changes. This will have the effect of continuing to prohibit street vending on those blocks, unless the VOC establishes new vending sites in those areas. A companion resolution to amend the Regulations Governing Street Vending in the High Density Vending Area will be introduced at a later date to update relevant regulations and vending maps.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (a) entitled “Scope and Definition of Mall/Concourse” of Subsection (6) entitled “Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse” of Section 9.13 entitled “License for Selling on Public Streets” of the Madison General Ordinances is amended to read as follows:
“(a) Scope and Definition of Mall/Concourse:.
1. Purpose. The physical design of the State Street Mall/ and the Capitol Concourse Improvement District as defined by Resolution No. 25,620, adopted by the Common Council on November 13, 1973; Resolution No. 33,431, adopted by the Common Council on September 12, 1978; and by Resolution No. 35,194, adopted by the Common Council on December 11, 1979, is are suited to street selling of handcrafted goods, personally prepared food and limited goods by contiguously-located, street-level or corresponding non-street level merchants and sidewalk cafes subject to such regulations as necessary to maintain the orderly use of the public streets and to protect the public health.
2. Included Streets and Boundary. For purposes of street vending under this ordinance, Tthe State Street Mall/Capitol Concourse Vending Area is defined to includes both sides of the street and the city sidewalks of the 100 through 800 blocks of the State Street Mall and the first block of every cross street intersecting State Street, in any direction; and the Capitol Concourse consisting of the first blocks of North and South Carroll Streets, the first blocks of East and West Main Streets, the first blocks of North and South Pinckney Streets and the first blocks of East and West Mifflin Streets as well as the additional areas included in the State Street Mall/Capitol Concourse Improvement District, and the first block of all cross streets intersecting with the Capitol Concourse in any direction; the 700 and 800 blocks of Langdon Street; and all other city streets and city sidewalks within the boundaries formed by the following streets, including both sides of the boundary streets unless otherwise noted: the 400-600 blocks of North Park Street, the 600 block of North Lake Street, the 200-600 blocks of Langdon Street, the 400-500 blocks of North Henry Street, the 100 block of West Gorham Street, the 200-300 blocks of North Carroll Street, the portions of each street forming the Outer Loop around the Capitol (Fairchild, Doty, Webster and Dayton Streets), the 200 block of West Mifflin Street, the 100 block of North Henry Street, the 300 block of West Dayton Street, the 200-300 blocks of North Broom Street, the northwest side of the 400 block of West Gorham Street, the 500-800 blocks of University Avenue on the north side of the street; Elizabeth Link Peace Park and the Municipal Building Vending Area.”
2. Paragraph 1. entitled “Langdon Street High Density Vending Area” of Subdivision (b) entitled “Definition of High Density Vending Area” of Subsection (7) entitled “Regulations and Procedures for Vending in High Density Vending Areas” of Section 9.13 entitled “License for Selling on Public Streets” of the Madison General Ordinances is hereby repealed.
3. Paragraph 2. entitled “Langdon Street 30-Day License” of Subdivision (e) entitled “Application for High Density Vending Licenses and Fees” of Subsection (7) entitled “Regulations and Procedures for Vending in High Density Vending Areas” of Section 9.13 entitled “License for Selling on Public Streets” of the Madison General Ordinances is hereby repealed.

“2. Langdon Street 30-Day License. A thirty (30) day license for the sales of goods and services is available for the Langdon Street High Density Vending Area. The license fee shall be one thousand dollars ($1000).”
