Body
WHEREAS, the City of Madison on June 12, 1973 adopted Resolution No. 24,966, File Number 5035-6, adding Official Map Sections 22, 27 and 34, Town 7 North, Range 8 East; and
 
WHEREAS, the City of Madison Official Maps, added by said resolution, contained various proposed streets and parkways, including proposed Pleasant View Road from existing Valley View Road north to Mineral Point Road; and
 
WHEREAS, the current adopted City of Madison Pioneer Neighborhood Development Plan includes relocated Pleasant View Road; and
 
WHEREAS, the City of Madison has reviewed and conditionally approved the preliminary plat of "University Research Park-Pioneer" submitted by the University of Wisconsin Board of Regents for lands included in the said Pioneer Neighborhood Development Plan; and
 
WHEREAS, the City of Madison on May 19, 2009 adopted Resolution No. RES-09-00483, File ID No. 14445 which Determined a Public Purpose and Necessity and approved an Amended Relocation Order for the acquisition of lands from the Theis property for Pleasant View Road right-of-way purposes; and
 
WHEREAS, as a result of recommended Pleasant View Road alignment changes by the Common Council, the proposed University of Wisconsin Board of Regents Subdivision Plat "University Research Park-Pioneer" will be revised to facilitate the proposed dedications for Pleasant View Road within the boundaries of the Subdivision Plat; and
 
WHEREAS, approved design plans for Pleasant View Road / Mineral Point Road requires public right-of-way interests across University of Wisconsin Board of Regents owned lands lying North of existing Mineral Point Road on both the East and West sides of existing Pleasant View Road to the North; and
 
WHEREAS, the University of Wisconsin Board of Regents has agreed to convey at no cost to the City of Madison, Permanent Limited Easements for Public Street Purposes for the construction of Pleasant View Road and Mineral Point Road; and
 
WHEREAS, the City of Madison Engineering Division has created the following City Project Numbers associated with the various Pleasant View Road / Mineral Point Road construction portions:
 
53W0390 - CTH M - Valley View Road - Pleasant View Road Intersection
53W0391 - Mineral Point Road (CTH S) and Junction Road (CTH M) Intersection
 
WHEREAS, the City of Madison will administer the acquisition of required land interests as identified on the attached Transportation Project Plat No. 5992-08-21-4.01 by Engineering Project No. 53W0391 and Office of Real Estate Services Master Project No. 9217; and
 
WHEREAS, as offered by the University of Wisconsin Board of Regents, the City of Madison will administer the no cost dedication of PLE land interests from the University of Wisconsin Board of Regents as identified on the attached Ayres Associates, John C. Favorite Plat of Survey by Engineering Project No. 53W0390 and Office of Real Estate Services Master Project No. 9219; and
 
 
WHEREAS, all required funding for the land interest acquisition is available in Account No. CS53-58110-810543-00-53W0391; and
 
NOW COMES THE CITY OF MADISON, Dane County, Wisconsin, by its City Council and for its Relocation Order hereby resolves as follows:
 
1.      That by adoption of this Resolution as a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes, inclusive of all associated maps and legal descriptions attached hereto and made part of this adopted  Relocation;
 
2.      That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessary in accordance with Section 32.07(2), Wisconsin Statutes, and that the acquisition shall allow for the construction of public improvements related to:
 
      53W0390 - CTH M - Valley View Road - Pleasant View Road Intersection
      53W0391 - Mineral Point Road (CTH S) and Junction Road (CTH M) Intersection
 
3.      That the City of Madison Office of Real Estate Services of the Economic Development Division and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Relocation Order, and the Office of Real Estate Services is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition;
 
4.      That the City of Madison Office of Real Estate Services of the Economic Development Division is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary;
 
5.      That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition;
 
6.      That the City Clerk shall file this Relocation Order with the Dane County Clerk in accordance with Section 32 of the Wisconsin Statutes;

$100,000 estimated for acquisition costs associated only with Engineering Project No. 53W0391 and staff time, funds available in: CS53-58110-810543-00-53W0391; and
 
No City fiscal impact for Permanent Limited Easement interests associated with Engineering Project No. 53W0390.
