Title
Authorizing the execution of an Amendment to Easement pertaining to a Gas Regulator Station Vault and Access Easement from the City to Madison Gas and Electric Company, within a public greenway at 404 Burdette Court.
Body
WHEREAS, the City of Madison and Madison Gas and Electric Company ("MG&E") are parties to a certain Gas Regulator Station Vault and Access Easement, dated March 6, 2008, (the "Easement") allowing MG&E to install a gas regulator vault and related facilities (the "Facilities") in the Easterly 50 feet of the Northerly 30 feet of the Easement, and allows ingress and egress to the Northerly 30 feet of the Easement, all being located within a public greenway at 404 Burdette Court; and
 
WHEREAS, the Facilities provide for the distribution of natural gas services to MG&E's customers; and
 
WHEREAS, the Facilities are located within the  "Easement Area" more particularly described below and depicted on attached Exhibit A; and
 
WHEREAS, MG&E has contacted City Engineering staff and requested that two underground gas lines, that lead to the gas regulator station vault, be permitted within the Easement Area previously limited to ingress and egress purposes only; and
 
WHEREAS, City Engineering staff have reviewed and approve of the placement of the underground gas line facilities within the Easement Area previously limited to ingress and egress purposes only; and
WHEREAS, the Office of Real Estate Services has prepared an Amendment to Easement for such purpose, and MG&E has reviewed and approves of the Amendment.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Amendment to Easement pertaining to the existing Gas Regulator Station Vault and Access Easement, dated March 6, 2008 (the "Easement"), from the City of Madison to Madison Gas and Electric Company ("MG&E"), which Amendment to Easement shall be on the following terms and conditions:
1.      The Easement shall be amended to provide that MG&E be permitted to install two underground gas line facilities (the "Additional Facilities") within the Easement Area previously limited to ingress and egress purposes only, as depicted on attached Exhibit A.
 
2.      The Additional Facilities will be installed over an existing City Engineering storm sewer pipe, and MG&E shall be responsible for any additional costs incurred by the City for future maintenance of said storm sewer pipe, due to the location of said Additional Facilities.
 
3.      All other provisions of the Easement shall apply to the Additional Facilities and shall remain in full force and effect.
 
 
 
Description of the Additional MG&E Underground Gas Line Easement Area
 
A parcel of land located within Lot 25, Block 1, 1st Addition to Rimrock Heights, located in part of the SW1/4 of Section 36, Township 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, to wit:
 
The Westerly most 85 feet (more or less) of the Northerly thirty (30) feet of said Lot 25.
 
The Additional Underground Gas Line Easement Area is depicted on attached Exhibit A.
