Title
Authorizing the Mayor and the City Clerk to execute a release of a portion of a public utility easement reserved in Lots 18 and 19 of the Plat of Colony Heights, located at 1602 Parkside Drive.
Body
WHEREAS, Amcor Flexibles, Inc., the owner of the property located at 1602 Parkside Drive, has requested the release of a portion of a platted utility easement reserved across said property; and
WHEREAS, easement releases from all public utility companies having an interest in such easement have been obtained and recorded; and
WHEREAS, City of Madison Engineering Division staff has reviewed the request and recommends the release of such easement
NOW, THEREFORE, BE IT RESOLVED, that the mayor and the City Clerk are hereby authorized to execute a Release of Public Utility Easement for land described as follows:
Part of a public utility easement located within Lots 18 and 19 Colony Heights recorded in Volume 40, Page 40 of Plats, and within Lot 2 Certified Survey Map No. 8996 recorded in Volume 50, pages 167-169 of Certified Survey Maps, Dane County Wisconsin Registry described as follows:
Commencing at the southwest corner of said Lot 2 Certified Survey Map No. 8996; thence N00º47'03" W along the west line of said Lot 2, 52.81 feet to a point on the original northwest line of said Lot 18; thence N45º58'57"E along said northwest line (recorded as N46º04'00"E) 14.73 feet to a point on the northeast line of a public sanitary sewer easement recorded as Document No. 3012050 and the point of beginning;
thence continuing N45 58'57"E along said northwest line of Lot 18, 130.55 feet to the northwest corner of said Lot 18; thence N44º01'03"W along the southwest line of said Lot 19 (recorded as N43º56'00"W) 141.73 feet to a point on the south line of a public sanitary sewer easement set forth on the Colony Heights Plat recorded as Document No. 1368992 and shown on Certified Survey Map No. 8996, recorded as Document No. 3006344; thence S89º31'36"E along the south line of said sanitary sewer easement, 16.82 feet; thence S44º01'03"E, 12.00 feet northeast and parallel with the original southwest line of Lot 19 colony Heights, 141.94 feet; thence S45 58'57"W, 12.00 feet southeast and parallel with the original northwest line of Lot 18 colony heights 141.42 feet to point on the northeast line of a public sanitary sewer easement recorded as Doc. No. 3012050; thence N49º23'45"W along said northeast easement line, 12.05 feet to the point of beginning.
