WHEREAS, on May 10, 2022, the Council adopted RES-22-00319 (File No. 70597), which resolution authorized the City to sell portions of the Yahara Hills Golf Course to the County for the County’s development of the lands as a future landfill, compost site and sustainable business park. The eastern 231.8 acres of the Golf Course were sold to the County for this purpose on February 27, 2023; and,
WHEREAS, Dane County has commenced the landfill siting process with the State of Wisconsin, seeking formal approval to develop a landfill on a portion of the former Yahara Hills Golf Course property (Dane County Landfill No. 3); and,
WHEREAS, as part of the landfill licensing process under State law, Wis. Stat. Sec. 289.33 details a local committee process whereby affected municipalities may participate in the negotiation and arbitration process pertaining to the development of the landfill (the Local Negotiating Committee); and,
WHEREAS, on June 20, 2023, the Common Council adopted RES-23-00465 (File No. 78136), which resolution authorizing the City’s participation in the local negotiation process for the development of Dane County Landfill No. 3 and allowing for the appointment of City representatives to the Local Negotiating Committee; and,
WHEREAS, the Village of McFarland, while located close to the proposed landfill, is not close enough to the proposed landfill site such that it is an affected municipality under the Statute, meaning that it is not entitled to participate in the local negotiation process as a party. Instead, pursuant to Sec. 289.33(7n)(a), in order to be added as a party to the local negotiating committee for Dane County Landfill No. 3, McFarland will need the written agreement of all the parties to the negotiation and arbitration process (Dane County, the Town of Cottage Grove, and the City); and,
WHEREAS, the City recognizes that McFarland’s interests are involved in the proposed development of Dane County Landfill No. 3 and that it and its resident’s interests would be served by allowing for McFarland’s participation in the local negotiations process for the landfill.
NOW THEREFORE BE IT HEREBY RESOLVED that, pursuant to Wis. Stat. Sec. 289.33(7n)(a), the City agrees to add the Village of McFarland as a party to the Local Negotiating Committee for the proposed Dane County Landfill No. 3 and authorizes the Mayor and City Clerk to enter into an agreement to that effect with Dane County and the Town of Cottage Grove, on a form approved by the City Attorney.
