Title
Adopting a Revised Relocation Order for the acquisition of Plat of land interests required for improvements for East Washington Avenue Segment 2 Reconstruction from Dickinson Street to Second Street (including North & South First Street from Winnebago Street to East Johnson Street and the East Washington Avenue Bridge over the Yahara River), being located in the Northeast 1/4 of Section 13, Town 7 North, Range 9 East, and part of the Southwest ¼ of Section 6 and part of the Northwest ¼ of Section 7, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin and authorizing the Mayor and City Clerk to sign all necessary documents necessary to accomplish the acquisition of land interests.

PREAMBLE
On May 18, 2004, the City of Madison Common Council adopted Resolution No. 61506, ID No. 35850 determining a public purpose and necessity and adopting a Relocation Order for the acquisition of land interests to improve East Washington Avenue Segment 2; and
Acquisition cost estimates, as a result of these revisions, are within previously budgeted funds.
After adoption of this relocation order, the City of Madison Engineering Division was approached by the owner of the existing shopping center, Twentieth Century Markets / Fiore Companies, requesting street geometric changes to the N. & S. First Street and East Washington Avenue; and
The primary geometric change was for the shopping center to perpetuate the existing ability for vehicles heading northerly-northwesterly, from East Washington Avenue towards East Johnson Street, to turn left into the shopping center off of N. First Street; and
The necessary design changes to accommodate this request, requires revised right-of-way interests from two previously included parcels and acquisition from one additional parcel not part of the original Relocation Order.
The two properties requiring revisions:
The shopping center at 1858 East Washington Avenue (Parcel 11 from previously approved Relocation Order). The other revised acquisition is from the City of Madison owned properties at 1903 East Washington Avenue and 1902 East Main Street (Parcel 13 from previously approved Relocation Order).
The one newly added parcel requiring right-of-way interest acquisitions:
Madison Metropolitan Sewerage District property at 104 N. First Street, shown on this revised Relocation Order as Parcel 20; and
A copy of this revised plat of right-of-way is attached to this resolution; and
All required funding for the land interest acquisitions by the City of Madison will be available in Account No. CS53-58110-810370-00-53B0202;
NOW COMES the City Of Madison, Dane County, Wisconsin, by its City Council and for its relocation Order hereby resolves as follows:
1. That this Resolution is a Relocation Order in accordance with Section 32.05(1) and 62.22, Wisconsin Statutes for the purpose of the within described public acquisition project and that this acquisition is determined to be necessity in accordance with Section 32.07(2), Wisconsin Statutes, and the acquisition shall allow for the construction of public improvements of East Washington Avenue from Blair Street to Thornton Avenue, being located in all parts of Section 13, Town 7 North, Range 9 East, and part of the Northwest ¼ of Section 7, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin.
2. That the City of Madison Real Estate Section of the Community and Economic Development Unit and the City Attorney are hereby authorized to proceed by negotiation or condemnation under authority of Section 32 and 62.22 of the Wisconsin Statutes to acquire the real estate interests shown on said Relocation Order, and the Real Estate Section is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition.
3. That the City of Madison Real Estate Section of the Community and Economic Development Unit is hereby authorized to execute the jurisdictional offer, lis pendens, and award of the compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary.
4. That the Mayor and City Clerk are authorized to sign all necessary documents necessary to accomplish the acquisition.
5. That the Mayor and City Clerk are authorized to execute an Agreement with the State of Wisconsin Department of Transportation to cooperatively acquire the necessary real estate interests to perform the improvements for East Washington Avenue Segment 2, WDOT Right-of-Way Project No. 5992-05-59 and WDOT Construction Project No. 5992-05-61.
