Fiscal Note
The proposed resolution authorizes a seven-year contract for elevator maintenance and repair services to the Parking Utility at an estimated cost of $40,800 per year and a total cost not to exceed $400,000 over the life of the contract. The Parking Utility will fund the contract from its operating budget and no additional appropriation authority is required.

Authorizing the Mayor and City Clerk to sign a seven (7) year non-competitive service contract with TK Elevator Corporation for the maintenance of elevators in the Wilson Street Garage. (District 4)
Body
WHEREAS, the elevators in the Wilson Street Garage have experienced numerous maintenance difficulties and outages since their installation; and,
WHEREAS, one compounding factor is the proprietary technology within the garage’s elevators, which requires maintenance outside of the available services from other elevator maintenance vendors; and,
WHEREAS, The Parking Utility has determined that a maintenance contract with TK Elevator Corporation for seven years with a total cost not to exceed: $400,000 and a projected base annual cost of $40,800 is reasonable solution; and,
WHEREAS, under MGO 4.26(3)(e), service contracts of more five (5) years in duration require Common Council approval and signature by the Mayor and City Clerk; and,
WHEREAS, a Non-competitive selection request has been completed,
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are authorized to sign a contract on behalf of the Parking Utility with TK Elevator Corporation for the purposes and at the price described above, for a term of seven (7) years in a form approved by the City Attorney; and,
BE IT FURTHER RESOLVED that the initial contract may be renewed at negotiated contract prices for two (2) additional terms of two (2) years each, upon mutual written agreement of the parties; and,
BE IT FINALLY RESOLVED that the Purchasing Agent is authorized to sign agreement(s) to effectuate the above renewals, if upon consultation with the Parking Utility they determine such renewal to be in the City’s best interest and the form of the renewal document is approved by the City Attorney.
