Title
Authorizing the Superintendent of Parks to enter into a First Amendment to the Marshall Park Use Agreement (District 19)
Body
On January 31, 2025, the City and Marshall Boats, LLC entered into the Marshall Park Use Agreement which sets forth the terms and conditions upon which Marshall Boats may use Marshall Park to conduct boat rental, instructional, concession and other recreational activities from 2025-2039.
Marshall Boats LLC would like to work with a contractor to provide a public sauna amenity at Marshall Park during the winter months, which the Parks Division is agreeable to allowing, as provided for in the agreement.
The Saunas will provide an opportunity for contrast therapy with sauna and cold plunge in a social setting. Marshall Boats LLC will be contracting with Portal X, an entity with experience providing public saunas in Denver and Minneapolis. The use fee for this expanded offering will be $5,000 for the 2025-2026 Winter season.
Under Section 14 of the Agreement, “[a]ny change in any provision of th[e] Agreement may only be made by a written amendment, signed by the duly authorized agent or agents of the Permittee and the Parks Superintendent, or his/her designee.” This amendment is before the Board of Park Commissioners for authorization, as the new recreational use would substantially change the use of the park compared to its current state.
