CALL TO ORDER
Ald. Brenda Konkel called the meeting to order at 4:36 p.m.
APPROVAL OF MINUTES

Approval of Common Council Organizational Committee minutes from |
|
December 14, 2004 meeting. |
1.
|
Ald. Jean MacCubbin requested a correction on page 7 under "Appointing |
|
Members to the CCOC Sister Cities Grant Review Subcommittee for 2005". It |
|
should read: "2. Make recommendations on a process for ORGANIZATIONS to |
|
apply as a sister city to Madison." |
Ald. Judy Compton arrived at 4:45 p.m.
ITEMS REFERRED FROM COUNCIL

Substitute Ordinance, ID# 33659 - To adopt and confirm amendments to certain |
|
sections of the Madison General Ordinances as set forth in attached Exhibit R |
|
pursuant to Sec. 66.0103, Wis. Stats., regarding street use permits. - See subsitute |
|
ordinance, draft 2nd substitute, Street Use Staff Team report. |

This item was referred to a special CCOC meeting scheduled for Tuesday, |
|
January 18, 2005 at 5:00 p.m. in Room 103A, CCB. (Meeting was subsequently |
|
cancelled by the Council President on 1/11/05) |
|
Creating new Section 2.04(2), renumbering current Sections 2.04(2) - (14) to 2.04(3) - |
|
(15), respectively, amending Sections 2.19, 2.30 and 3.27(4)(g) of the Madison General |
|
Ordinances to modify various rules of procedure for the Common Council and boards, |
|
committees, and commissions. |

creating Section 3.46 entitled "Obsolete Committees and Commissions" of the |
|
Madison General Ordinances to establish that any committee that has not met in a |
|
calendar year would be automatically terminated by April 1 of the next year unless the |
|
Council acts before April 1 to keep the committee active or unless the committee is |
|
required by state statute or contract. |

It was noted that Ald. Zach Brandon had requested that this item be rereferred to |
|
the CCOC meeting of February 1, 2005. Ald. Jean MacCubbin had questions on |
|
the March 1 deadline and turnaround time for CCOC to act each year. |
|
Amending Sections 2.40(2)(e), (2)(g), (3)(e), (3)(h), (6)(a), (6)(c), (7), (8), (9), (10)(a), |
|
(11)(b), (11)(c), (11)(e), (11)(f), and (12), creating new Section 2.40(13), and |
|
renumbering current Sections 2.40(13) through (15) to Sections 2.40(14) through (16) of |
|
the Madison General Ordinances to modify portions of the lobbying ordinance. |

Ms. Newton had concerns that the ordinance doesn't differentiate on types of |
|
contacts. Her concern was for the "little guy" being penalized. She noted as an |
|
example a liquor license renewal - they have contact with the city or alders and |
|
appear before the ALRC. She doesn't think that they will know that they need to |
|
comply with the lobbying ordinance. She thought the intention of the ordinance |
|
to get at those that influence policy decisions and feels that the ordinance will |
|
affect a broader population. She distributed a memo that highlighted Milwaukee's |
|
lobbying ordinance provisions and thought that these should be considered for |
|
Madison's lobbying ordinances. She also included her Smart Growth Madison's |
|
recommendation that "administrative action" and "legislative action" should be |
|
defined. (see attached memo). |

Ald. Jean MacCubbin asked Ms. Newton if she had concerns about the lack of the |
|
posting/accessibility of the lobbying information. She would like to be able to file |
|
the form electronically on-line. |
|
Ald. Paul Van Rooy asked City Attorney Michael May if the definition of "lobbying" |
|
could be more clearly defined. City Attorney May believed that the definition was |
|
clear on who was a lobbyist and that by deleting exemptions it further clarifies the |
|
definition. |
|
Ald. Brian Benford asked what the downside was of the registration process. City |
|
Attorney May noted that the simple act of registering is not the issue with |
|
lobbyists but rather reporting the information. He indicated that if the person |
|
spent less than $500 there was no reporting other than checking a box. |
|
Ald. Paul Van Rooy asked if there was a distinction between someone who |
|
lobbying to change policy and someone who is lobbying on a project. City |
|
Attorney May indicated that there was no distinction - it is either an administrative |
|
action or a legislative action. |
|
Ald. Brenda Konkel asked how the City Attorney's office would be checking on |
|
complaints. City Attorney May stated that they would be reviewing registration |
|
forms and be relying on the person to identify themselves as lobbyist or |
|
committee members to ask the person is they are representing someone or not. |
|
Ald. Brian Benford asked what the downside was of the ordinance. City Attorney |
|
Michael May indicated that education and complaints about the paperwork have |
|
been the two frequent complaints. Both of those issues have been worked on |
|
and appear in the new ordinance language. |
|
Ald. Paul Skidmore indicated that he didn't think that the ordinance was a bad |
|
idea and that he thought that the effort to provide more education to the public on |
|
the ordinance would be beneficial. He believed that the ordinance would need to |
|
be "tweaked" as time goes on but fully supported the ordinance changes. |
|
Ald. Judy Compton thought that at times the paperwork had a chilling effect and |
|
would like to see the definition of "payment" defined more fully. |
|
Ald. Robbie Webber stated that when someone appears before a committee at the |
|
grassroots level and is not being paid that it is very different from a person who is |
|
being paid to represent someone appearing before a committee. She thought that |
|
the registration form is very clear on that distinction. |
|
Ald. Brenda Konkel disclosed that she works for an agency that employs a |
|
lobbyist. |
|
Information Services staff were requested to be present at the February 1, 2005 |
|
CCOC meeting to discuss lobbyist information on the city's website. |
|
Amending Section 2.05(1) of the Madison General Ordinances to require a two-thirds |
|
majority vote for items to be introduced to the Common Council by title only, and |
|
creating Section 2.41 of the Madison General Ordinances to establish a Rules |
|
Committee to review obsolete ordinances. |

It was noted that Ald. Zach Brandon had requested that this item be rereferred to |
|
the CCOC meeting of February 1, 2005. Ald. Jean MacCubbin questioned why |
|
this couldn't be part of the City Attorney's Work Plan. |
DISCUSSION ITEMS
Creating a Madison Elections Advisory Commission.

The members approved the creation of a subcommittee of CCOC to review the |
|
issue of creating a Madison Election Advisory Committee. Members include Ald. |
|
Brenda Konkel, Ald. Jean MacCubbin and Ald. Paul Van Rooy. Sharon |
|
Christensen (Deputy City Clerk) and Paul Malischke will be invited to attend. |
|
Subcommittee will report back with recommendations to the CCOC at a future |
|
meeting. |
Legistar (legislative tracking) Update - Lisa Veldran

|
Lisa Veldran provided an update on the legislative tracking implementation. Ald. |
|
Jean MacCubbin thought that the Project Implementation Team should be |
|
formally thanked. |
