Fiscal Note

The proposed resolution authorizes an amendment of a noncompetitive contract with Maxim Healthcare Staffing Services, Inc. to extend their services to support Public Health Madison and Dane County’s COVID-19 testing, contact tracing and vaccine administration. The services are paid for through various funding streams to support COVID-19 response efforts, including Federal Emergency Management Agency (FEMA) Public Assistance reimbursements, CDC Epidemiology and Laboratory Capacity grants, and COVID-19 Testing Pilot Program funding. The amendment extends the term of the contract for an additional year to February 1, 2023, at a price not to exceed $3,500,000 with the option of three additional 1-year renewal terms which may be executed by the Director and are subject to appropriate budget authority and budget availability. No appropriation is required at this time.

A Resolution authorizing an amendment of a noncompetitive contract with Maxim Healthcare Staffing Services, Inc. to extend their services to support Public Health Madison and Dane County’s COVID-19 testing, contact tracing and vaccine administration.

 

Body

WHEREAS, Public Health Madison and Dane County (PHMDC) has been working with Maxim Healthcare Staffing Services, Inc. to support COVID-19 emergency response efforts to supplement staffing levels in the areas of contact tracing, testing, and vaccination; and

WHEREAS, on January 19, 2021, the Common Council authorized the execution of a service contract with Maxim Healthcare Staffing Services, Inc. (“Maxim”) via File No. 63563; and

WHEREAS, the services have been paid for through various funding streams to support COVID-19 response efforts, including Federal Emergency Management Agency (FEMA) Public Assistance reimbursements, CDC Epidemiology and Laboratory Capacity grants, and COVID-19 Testing Pilot Program funding; and

WHEREAS, due to the ongoing nature of the pandemic the original contract has been amended three times:  on April 6, 2021 to exercise an option to extend the term of the contract to February 1, 2022, add FEMA terms and conditions, and add critical tier pricing; on July 27, 2021 to add mileage reimbursement for Maxim staff participating in mobile vaccination clinics; and on October 14, 2021 to increase the total contract price; and 

WHEREAS Maxim and their staff have been a critical component of the COVID-19 response efforts in Madison and Dane County; and

WHEREAS, due to the ongoing nature of the COVID-19 response, the services of Maxim will be needed beyond the amended end date of February 1, 2022 and throughout the duration of the COVID-19 response; and

WHEREAS, MGO 4.26 requires Common Council approval of service contracts of $50,000 or more if the contractor was not selected through a competitive selection process, and the reasons for selecting this contractor are set forth above and in the attached Noncompetitive Selection Request Form and this amendment amounts to a new contract of more than $50,000, requiring additional Council approval;

NOW, THEREFORE, BE IT RESOLVED, that the Director of Public Health is authorized to execute a fourth amendment to the service contract with Maxim Healthcare Staffing Services, Inc. to extend the term of the contract for an additional one year to February 1, 2023, at a price not to exceed $3,500,000 with the option of three additional 1-year renewal terms which may be executed by the Director; subject to appropriate budget authority and budget availability; and

 

BE IT FURTHER RESOLVED that the Director is authorized to sign similar amendments in the future to adjust bill rates, increase total compensation, extend the term of the contract beyond that authorized above for the duration of the COVID-19 response efforts, or other adjustments, subject to budget availability and in a form approved by the City Attorney.
