Fiscal Note

The proposed resolution authorizes the waiver of street vending fees for the 2021-2022 season. This is an extension of adopted RES-20-00333 (File 60117) and RES-20-00585 (File 61272), both of which waived and refunded street vending fees for the 2020-2021 season. The fee waiver will likely have the same revenue loss as estimated for 2020 at $232,000. The estimated loss assumes no fee collection for basic street vending, food vending, late night vending, campus vending, mall vending, and sidewalk cafes.

A Resolution waiving all Street Vending fees under MGO 9.13 for the 2021-2022 vending season and extending existing vending licenses for vendors in good standing from the 2020-2021 season to the 2021-2022 season.

Body

WHEREAS,    due  to the hardship created by the Covid-19 pandemic on businesses in the food and beverage industry, the Mayor via Emergency Order (on March 23, 2020) and the Common Council via Resolution File No. 60117 (adopted April 21, 2020) waived almost all street vending license fees for the 2020-2021 vending season;  and

 

WHEREAS,  for the same reasons,  the Fall Food Vending Cart review which would have occurred in August of 2020 was cancelled via Resolution File No. 61272 and existing, licensed Mall Food Cart vendors were allowed to continue their site assignments for the 2021-2022 vending season and procedures were established to administer this; and

 

WHEREAS, the process for applying for street vending licenses for the 2021-2022 vending season begins on January 1, 2021 with some deadlines in February; and

 

WHEREAS,  due to the continued hardship, the Street Vending Coordinator, the Office of Business Resources and the Mayor’s office recommend waiving all vending license fees for all street vendors for the 2021-2022 season (from April 15, 2021 to April 14, 2022);  and

 

WHEREAS,  this includes Mall/Concourse Food Vendors, Arts and Crafts, Sidewalk Cafes, Merchant Vendors, Basic Street vending licenses, Southeast Campus, Top of State Street (TOSVOD), Late Night, and Camp Randall High Density vending licenses; and

 

WHEREAS,  to create efficiencies and further assist vendors, it is recommended that existing annual vending licenses for the 2020-2021 season be automatically continued, provided the vendors demonstrate continued required insurance and maintain all applicable food and beverage and other health licenses;

 

NOW, THEREFORE,  BE IT RESOLVED  that all license, application, and late fees required for every street vending license type under Sec. 9.13 of the Madison General Ordinances are hereby waived for the street vending license season that begins on April 15, 2021 and ends on April 14, 2022; and

 

BE IT FURTHER RESOLVED this Resolution supersedes any requirement in Resolution File No. 61272 for payment of any application, late, and license fees for Mall/Concourse Food Vendors any other vendors who avail themselves of the process in File No. 61272 for the 2021-2022 season; and

 

BE IT FINALLY RESOLVED that all currently-licensed street vendors in good standing as required by sec. 9.13 may continue to vend with their 2020-2021 license(s) for the 2021-2022 street vending season provided they continue to hold the required insurance and applicable food and beverage and other health licenses, and the Street Vending Coordinator is authorized to create procedures to effectuate this, and new vendors may apply for vending licenses for the 2021-2022 season following usual procedures (or alternate procedures in Resolution No. 61272) but need not pay any fees.
